Dear Correctional Services Department,

I am writing to make an information access request regarding guidelines on private clothing received by immigration detainees at Tai Tam Gap Correctional Institution (TTG).

May I know,

1. Are immigration detainees at TTG allowed to receive clothing brought from outside?
2. If so, are there guidelines on clothing brought from outside (ex. By family or friend visitors) that can or cannot be received?
3. If so, may I receive a copy of such guidelines for reference?

Dear Sir/ Madam,

I refer to your application for access to information under the Code on
Access to Information (“the Code”) to this Department on 24.10.2022 and
our interim replies to you on 1.11.2022 and 11.11.2022.

By virtue of rule 196 of the Prison Rules (Cap. 234A), detainees at Tai
Tam Gap Correctional Institution may receive private clothes from outside
as may be approved by the Superintendent.  All articles of clothing so
handed in are subject to checking for the maintenance of institutional
security, order and discipline.

Since we do not have a specific guideline on the above, your request could
not be acceded to pursuant to paragraph 1.14 of the Code.
 
You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.
 Furthermore, pursuant to paragraph 1.26 of the Code, any person who
believes that a department has failed to properly apply any provision of
the Code may also complain to The Ombudsman.  The Ombudsman’s address is –
