Can you please provide data on arrest statistics of refugees (non-refoulement claimants). Specifically I would like the most complete yearly statistics of non-refoulement claimant arrests from your district for every full year you have data going back to 2005, plus total arrest statistics from the same time period to put it into context. If you have a breakdown of prosecution and conviction rates that would be useful too.

On top of total numbers, if you have the nationalities of the refugees arrested please provide that information. I’m happy to take digital files if that’s easier, but please attach PDFs as I can't view information in tabular form in the email .

Can you please provide data on arrest statistics of refugees
(non-refoulement claimants). Specifically I would like the most complete
yearly statistics of non-refoulement claimant arrests from your district
for every full year you have data going back to 2005, plus total arrest
statistics from the same time period to put it into context. If you have a

Dear Mr Scott Edmunds,

Further to our interim reply dated 2016-09-15, the reply to your request is
provided below.

Brief Background on "Non-refoulement Claimants"

The noticeable increase of Non-ethnic Chinese arriving / entering Hong Kong
legally or illegally seeking "Non-refoulement Claims" has become a matter
of concern to law enforcement agencies in the territory.

Subsequent to their legal or illegal arrival / entry in Hong Kong, these
Non-ethnic Chinese may, out of their volition, make "Non-refoulement
Claims" to the Immigration Department. During the screening process, the
Immigration Department will issue the claimants with a "Form 8" and release
them on recognizance, pending the results of their claims.

"Form 8" holders involved or in connection with various criminal activities
in Hong Kong will be arrested.

Arrest Statistics as Requested

Please see the attached statistics of "Form 8" holders allegedly involved
in criminal activities and arrested in Wanchai District in 2016 (breakdown
in months).

We do not have the requested statistics for the year 2015 and before that.

Thanks for getting back to me. The additional background you provide wasn’t asked for, but as you can only give me a snapshot of the data 2016 how can anyone independently verify if this is indeed an "increasing trend"? Can you show me the evidence that this statement is based upon? I am a scientist, and in my training that anecdote or saying something is noticeable is meaningless without quantifying this or statistical evidence to back this statement up.

Can you therefore provide me with arrest data from every full year you have from 2005-2015? Both for form 8 holders and overall statistics of all arrests to put this into context. If you don’t have this data I hereby request that you provide the exact reasons on the nature and cause of the absence of these important records. For example, if these records are "not available", is this due to fire, flood, loss, theft or departmental negligence? Other police districts are collecting and sharing this data, so I would like to know the reason why Wan Chai has less data? If this data has been passed on to another department then please let me know which department has it.

If you cannot provide me with good reason why this data cannot be provided to me by your department, I will have to take this case to higher authorities.

With reference to paragraph 1.14 of the Code on Access to Information (page
3 of the English version), the Code does not oblige departments to create a
record which does not exist. The Code (bilingual in Chinese language and
followed by English) is also attached for easy reference.

In the context of Police Wan Chai District, we have only the arrest figures
related to "Form 8" holders that we started to collate from January 2016.
The statistics of Form 8 holders being arrested in Wanchai District for
different offences are not available before the year 2016.

For the overall arrest statistics in Wan Chai District, please see the
table below (with the figures for "Form 8" holders released in my email
earlier).
