Terms and Conditions of Use

1.  The  information  provided  by  the  Government  of  the  Hong  Kong  Special
Administrative Region ("the Government") on the boundary maps of Existing
Villages  and/or  Market  Towns,  including  but  not  limited  to  digital  maps,
mapping information, lot information, aerial photographs, facility information,
geographic information ("Information"), is for general reference only and is not
intended to be relied upon.    No statement, representation or warranty, express
or  implied,  is  given  by  the  Government  as  to  its  accuracy,  completeness  or
appropriateness  for  use  in  any  particular  circumstances.    The  Government
shall  not  be  liable  for  any  errors,  omissions,  misstatements  or
misrepresentations (express or implied), concerning any Information, and shall
not have or accept any liability, obligation or responsibility whatsoever for any
loss,  destruction  or  damage  (including  without  limitation  consequential  loss,
destruction or damage) howsoever arising from or in respect of using, misusing,
inability to use, or relying on the Information.

2.  The  Government  does  not  warrant  or  represent  that  boundary  maps  of
Existing Villages and/or Market Towns or any Information or any electronic
data  or  information  transmitted  from  the  Government  to  users  through
boundary  maps  of  Existing  Villages  and/or  Market  Towns  is  free  of
computer viruses.    You are advised to perform virus scanning before using the
Information.    The Government  shall not  be liable for any loss, destruction or
damage  arising  out  of  or  in  relation  to  any  transmission  from  users  to  the
Government or vice versa over the internet.

3.  The  Government  shall  not  be  responsible  for  any  loss  or  damage  whatsoever
arising  out  of  or  in  connection  with  the  Information.    The  Government
reserves the right to revise, omit, suspend or edit the Information at any time in
its  absolute  discretion  without  giving  any  reason  or  prior  notice  to  users.
Before acting upon the Information, users are:

(i)
responsible for making their own assessment of the Information;

(ii)
advised  to  verify  the  Information  by  making  reference,  for  example,  to
original  publications,  other  relevant  documentation  and  site  situation;
and

(iii)
advised to obtain independent advice from relevant professionals.

4.  Without limiting the generality of the foregoing, nothing on or provided via the
boundary maps  of Existing  Villages and/or Market Towns  shall constitute,
give rise to or otherwise imply any endorsement, approval or recommendation
on  the  Government's  part  of  any  third  party,  be  it  a  provider  of  goods  or
services or otherwise.

5.  The  Government  does  not  undertake  to  provide  any  updated  version  of  the
Information and reserves the right to suspend the provision of  the Information
at any time.    No warranty, condition, undertaking or term expressed or implied
is given or assumed by the Government.

6.  The  Government  shall  not  be  responsible  to  install  the  Data  or  provide  any
training in the use of Data and gives no warranty that the data can be processed
on the Computer Configuration.

7.  The Government reserves all rights that are not expressly granted in this Terms
and Conditions.

Use of Information on the boundary maps of Existing Villages and/or Market
Towns

8.
(a)  You  are  permitted  for  academic  research  and/or  analysis/  study

purpose to use, copy and print in their original format any Information
on  the  boundary  maps  of  Existing  Villages  and/or  Market  Towns,
provided that:

(i)  the  user  agrees  not  to  make  any  change  to  or  deletion  of  author
attribution,  trademark,  legend,  intellectual  property  rights  notice
or  terms  and  conditions  of  use  and  give  proper  attribution  to  the
Government and the boundary maps of Existing Villages and/or
Market Towns; and

(ii)  the  user  shall  identify  clearly  the  source  of  the  Information  and
acknowledge  the  Government  ownership  of  the  intellectual
property  rights  in  the  Information  in  all  copies  thereof  including
but not limited to paper copies, digital copies and copies placed on
websites.

(b)  Organizations  or  institutions  who  wish  to  use  any  Information  on  the
boundary  maps  of  Existing  Villages  and/or  Market  Towns  for

academic  research  and/or  analysis/  study  purpose  must  comply  with
the requirements set out in paragraph 8(a)(i) and (ii) above and provide
relevant valid information before copying or printing any  Information
on the boundary maps of Existing Villages and/or Market Towns.

(c)  The  prior  written  consent  of  the  Government  ("Permission")  is
required  before  the  use  of  the  Information  in  any  way  other  than  the
permitted use for academic research and/or analysis/ study purpose and
such  Permission  may  be  subject  to  additional  terms  and  conditions
which  may  include  the  requirements  set  out  in  paragraph  8(a)(i)  and
(ii) above and may be subject to additional fee.

9.  The  Information of the  boundary  maps of Existing Villages and/or Market
Towns  shall  all  be  destroyed  after  the  completion  of  the  academic  research
and/or analysis/ study project.

10.  Should  there  be  any  infringement  of  property  right  of  the  Information  of  the
boundary maps of Existing Villages and/or Market Towns, the user is liable
to compensate the Government for any loss and damage.

Intellectual Property Rights

11.  Unless  otherwise  indicated,  the  Government  is  the  owner  of  the  intellectual
property  rights  in  all  contents  available  on  the  boundary  maps  of  Existing
Villages and/or Market Towns, including but not limited to all Information.

12.  The Government reserves all rights that are not expressly granted in the Terms
and  Conditions  of  Use.    For  the  avoidance  of  doubt,  the  permission  given  in
paragraph 8 above does not extend to any Information that are contributed by a
third party as identified and acknowledged in the boundary maps of Existing
Villages  and/or  Market  Towns.    If  you  intend  to  reproduce,  distribute  or
otherwise  use  any  Information  that  is  contributed  by  a  third  party,  you  shall
obtain all necessary authorization or permission from such third party.

13.  The  Government  remains  the  owner  of  the  Data  at  all  times.    The  user  shall
not copy or otherwise infringe any intellectual property rights the Government
may have in the data, whether in whole or in part.

14.  Prior written consent must be obtained from the Government before the user is

permitted to incorporate the Data (or any part thereof, whether on hard copy in
digital  form  or  in  any  other  form)  in  any  product  (in  whatever  media)  for
distribution to any third party, with or without charges.

Governing Law

15.  The Terms of Use shall be governed and construed in accordance with the laws
of the Hong Kong Special Administrative Region of the People’s Republic of
China.  You  also  agree  to  submit  to  the  exclusive  jurisdiction  of  the  courts  of
Hong Kong.
