1. The number of non-refoulement claims pending screening by the Immigration Department ("ImmD") as of (i) 31 December 2020 and (ii) 30 September 2021;
2. The number of non-refoulement claimants who have lodged appeals or are pending decisions by the Torture Claims Appeal Board / Non-Refoulement Claims Petition Office ("TCAB/NRCPO") as of (i) 31 December 2020 and (ii) 30 September 2021;
3. The number of non-refoulement claimants who have a pending application for leave for judicial review or application for judicial review against ImmD's Unified Screening Mechanism / TCAB/NRCPO decisions as of (i) 31 December 2020 and (ii) 30 September 2021;
4. The number of non-refoulement claimants pending removal or were not removable claims pending screening by Immigration Department as of (i) 31 December 2020 and (ii) 30 September 2021.

Dear Sir/ Madam,

I refer to your request for access to information on 11 October 2021.  In
consultation with the Immigration Department (“ImmD”), the requested
information is provided as below, please.

1.  As at the end of December 2020, apart from 563 non-refoulement claims
pending screening by ImmD, there were around 700 cases of which the
screening procedure had yet to commence due to the Coronavirus Disease
2019 pandemic.  As at the end of September 2021, there were a total of
1,213 non-refoulement claims pending screening by ImmD.

2.  As at the end of December 2020, 1,742 unsuccessful claimants had
lodged an appeal against ImmD’s decision to the Torture Claims Appeal
Board / Non-refoulement Claims Petition Office or were those who were
within the 14-day time limit for lodging an appeal.  As at the end of
September 2021, there were 2,047 such claimants.

3&4.  For detailed statistics on applications for judicial review (“JR”)
by claimants, please approach the Judiciary for such information.  As at
the end of December 2020, according to ImmD, apart from some 8,400 who had
applied to the Court for leave to apply for JR, 1,292 unsuccessful
claimants remained in Hong Kong for other reasons (e.g. being imprisoned,
remanded, involved in ongoing prosecution or investigation process, or
having absconded, etc.), while removal from Hong Kong was being arranged
for the remaining 1,267 persons.  As at the end of September 2021,
according to ImmD, apart from around 8,600 who had applied to the Court
for leave to apply for JR,1,248 claimants remained in Hong Kong for other
reasons, while removal from Hong Kong was being arranged for the remaining
1,686 persons.
