Dear Immigration Department,

I am writing to make an information request regarding removal procedures when a migrant (ie. Non-local person) is liable to be removed (ie. Whether due to a deportation / removal order, or other). May I know,

1) In the case of voluntary repatriation, what is the procedure / guidelines for removal?

2) In the case where a migrant person is able to finance their own ticket to return home, what would be the relevant procedure / policy in facilitating removal?

3) For both #1 and #2, if there is a copy of the relevant guidelines/ procedures / policies that may be available, I would greatly appreciate it.

Dear H. Y. Fung,
I refer to your request for access to information on 10 June 2022.
 Further to our interim reply of 16 June 2022, our reply is provided as
below.

In general, removees are required to pay the relevant travelling expenses
on their own.  The Immigration Department (ImmD) will arrange suitable
transportation for removees’ return to their places of origin as soon as
possible, having regard to the actual circumstances of individual cases.
 To effect the repatriation, ImmD will seek assistance from the relevant
authorities for re-entry facilities of the removees, such as issuing
relevant travel documents, as necessary.

Persons who seek to enter Hong Kong at control points but are refused
permission to land will be removed as soon as practicable.  Pursuant to
the Immigration Ordinance, Cap. 115, removal of the refused landing
passengers are normally arranged by the captains, owners or agents of the
incoming ships or aircrafts concerned to their port of embarkation / a
destination at which there is good reason to believe they will be admitted
and the expenses of the removal are met by the owners of the ships or
aircrafts.

 Further to our interim reply of 26 July 2022, our reply is provided as
below.

Removees mentioned in our earlier reply refers to any person or persons
liable to be removed from Hong Kong under the Immigration Ordinance, Cap.
115, Laws of Hong Kong.  They are required to pay the relevant travelling
expenses on their own in general.  In the event that they are unable to
pay the relevant expenses, public money may be used to remove the persons
concerned from Hong Kong as soon as possible to safeguard the public
interest, having regard to the circumstances of individual cases.
 Therefore, total expenditure on repatriation covers all relevant
travelling expenses including meal expenditure and air ticket fees.
