Dear Mr. Wang,

I refer to your application to the Planning Department vide your email
dated 19 May 2021 enquiring on the involvement of the Planning Department
and the Town Planning Board (the Board) in the decision process of the
decontamination project for the Cadogan Street Temporary Garden (the
Garden).  This serves as a consolidated reply from both the Planning
Department and the Board.

The area where the Garden is located has largely been zoned as “Open
Space” (“O”) since the gazette of the first Outline Zoning Plan (OZP) for
the Kennedy Town & Mount Davis area for open space development.

On 11 March 2016, the draft Kennedy Town & Mount Davis OZP No. S/H1/20 was
exhibited for public inspection under section 7 of the Town Planning
Ordinance (the Ordinance).  Amendment Item C2, which covered the area
currently occupied by the Garden, was proposed to be rezoned to
“Residential (Group)A” for residential development.  After the Board’s
consideration of representations and comments on representations under
Section 6B of the Ordinance, the Board considered that the CSTG should be
retained for open space use and the area was subsequently rezoned to “O”.
 We believe that such decision is what that was referred to in the article
from the newspaper referenced in your email.  You may refer to the
relevant papers regarding the proposed amendments at the Board’s website
below:

The Board’s decision on the proposed amendment was solely to reflect the
intention for retaining the site for open space use.  The decontamination
project for the Garden, which is under the purview of the Civil
Engineering and Development Department (CEDD), did not form part of the
amendment of the OZP.

According to paragraph 1.15.1 of the "Code on Access to Information –
Guidelines on Interpretation and Application", we are required to seek
your written consent to refer your application to the relevant department
(i.e. CEDD) for their direct response to you.  I should be grateful if you
could provide us (e-mail: [3][Planning Department request email]) with your written
consent on or before 28-5-2021.  In case we do not receive your written
consent by the said date, we will suppose that you do not require our
referral service.

Alternatively, you may wish to contact CEDD directly regarding the details
and the latest status of the concerned decontamination project.
