Application of stay permit for asylum seekers and refugees
Dear Immigration Department,
I am writing this to know about the asylum seekers and refugees families eligibility to apply for stay permit in Hong Kong if there is a slight chance of them getting a visa to have better future and more opportunities in HK I have came across a lot of people who have applied for the stay permit in HK yet they have to wait a really long time for their application to be processed it will be really helpful to know how long does an application takes to go through if a person/family meets the requirements of getting a staying permit in HK also how what’s the number of the applications that have been proceed and are still being processed for those who have applied.

In general, unless a person has the right of abode or right to land in the
Hong Kong Special Administrative Region (“HKSAR”), he/she requires a
visa/entry permit to work, study, establish or join in any business, take
up residence or to stay in the HKSAR as a visitor longer than the allowed
visa free period. While each application is determined on its individual
merits, an applicant should meet normal immigration requirements (such as
holding a valid travel document with adequate returnability to his/her
country of residence or citizenship; be of clear criminal record and raise
no security or criminal concerns to the HKSAR; etc.), as well as the
relevant specific eligibility criteria before he/she may be considered for
the grant of a visa/entry permit. You may wish to refer to the details in

Moreover, please note that the 1951 United Nations Convention relating to
the Status of Refugees and its 1967 Protocol have never applied to Hong
Kong, and the HKSAR Government maintains a firm policy of not granting
asylum and not determining or recognising refugee status of anyone.

information received on 10 June 2022. Further to our interim replies on
17 June 2022 and 30 June 2022, I am authorised to give you a substantive
reply as follows.
We would like to reiterate that the 1951 United Nations Convention
relating to the Status of Refugees and its 1967 Protocol have never
applied to Hong Kong, and the Hong Kong Special Administrative Region
Government maintains a firm policy of not granting asylum and not
determining or recognising refugee status of anyone. Your requested
information does not exist.
The case has been reviewed by a senior officer of the Immigration
Department previously not involved in the case. If you are not satisfied
with the above reply, you may consider lodging a complaint with the
Ombudsman, whose address is –
