Dear Immigration Department,

I am writing to make an information access request regarding immigration detainees making applications for legal aid and filing for judicial review. May I know,

A) For immigration detainees, what is the procedure for applying for legal aid?

B) For immigration detainees, what is the procedure for applying for judicial review?

C) For both A) and B), is the relevant procedure / application process communicated to detainees? And if so, how?

D) For both A) and B), would it be possible to provide a copy of the relevant procedures / guidelines?

Dear Gigi Lo,

I refer to your email of 11 June 2022.  Your requested information relate
to the applications for legal aid and judicial review, which fall into the
purview of the Legal Aid Department ("LAD") and Hong Kong Judiciary
respectively.  

In the light of above, we have no further comment on Question (C)
mentioned in your email.

For information regarding the application for judicial review (i.e.
Question (B) and (D)), upon the advice from Hong Kong Judiciary, you may
wish to make the request to them directly.

Regarding Question (A) and (D) concerning the application for legal aid, I
should be grateful for your consent for our referral of your request to
LAD for their direct reply.
