Code on Access to Information
Application No. 75/2020
        I refer to your application under the Code on Access to
Information received on 17 October 2020.

        The Education Ordinance (EO) empowers the Permanent Secretary of
the Education Bureau (EDB) to refuse to register an applicant as a teacher
and to cancel the registration of a teacher based on the circumstances set
out under section 46 and section 47 respectively.  The EDB can only
provide figures for the past 10 years.  In the past 10 years (2010 to
2019), the EDB handled a total of 585 cases relating to the suspected
professional misconduct of teachers, of which the registration of 72
teachers were cancelled.  

        As each case has its uniqueness and the decision of cancelling the
registration of a teacher may involve more than one of the situations as
specified in section 47 of the EO, we have not categorized the cases as
requested.

        If we are to provide the requested information, all the 585 cases
handled in the past 10 years will have to be retrieved and studied to
locate the 72 cases and categorized them as requested.  The documents
include records of discussion at EDB’s internal meetings.  Besides, to
avoid disclosing personal data of each case, we need to find such
particulars from each page of the document and read through every line to
mask the information.  As each case involves huge volume of papers, such
actions require heavy workload and manpower.  As disclosure of information
as requested bears little or no implications on public interest, we do not
consider it worth to conduct the above-mentioned work which involves huge
manpower.  In accordance with para 2.9(d) and para 2.10(b)(i) of the Code
which state that a department may refuse to disclose information which
could only be made available by unreasonable diversion of a department’s
resources and the records of discussion at any internal government
meeting, the information requested cannot be provided.

        If you are not satisfied with the above decision, you may write to
request an internal review of your case.  Alternatively, you may consider
lodging a complaint to The Ombudsman whose contact is at:
