Detainees at MTKDC as at August 2021
Dear Immigration Department,
I would appreciate if you could provide the number of detainees at the Ma Tau Kok Detention Centre (MTKDC) as at 31 August 2021 (or any other date that is convenient to you for the purpose of collating relevant information under this request), disaggregated by:
(1) Detainees’ age (under 18, 18 – 30, 31- 40, 41-50, 51-60, 61-70, 71-80, Above 80 or other categories as appropriate)
(2) Detainees’ sex (male, female, transgender)
(3) Detainees’ nationality (please provide a breakdown of all nationalities)
(4) Detainees’ immigration status (non-refoulement claimants (“NFCs”) within the USM, former NFCs with ongoing judicial review applications, former NFCs pending removal, illegal entrants (excluding NFCs), overstayers (excluding NFCs), persons refused entry (excluding NFCs), former foreign national prisoners pending removal and other categories as appropriate)

4. Overview of Detainees at MTKDC as at 31 August 2021:
Non-refoulement claimants*: 25
Overstayers: 3

*Remarks:
On 31 August 2021, there were 25 detainees at the MTKDC who had lodged
non-refoulement claims. Amongst them, 3 were pending final determination
of their claims, while the remaining 22 were pending removal from Hong
Kong, including those who were rejected non-refoulement claimants having
lodged applications for judicial review to the courts and the removal
arrangements were suspended under the prevailing policy. The number of
claimants under detention varies from time to time, depending on the
changes in the circumstances of individual cases.
