Official Complaints
Dear Immigration Department,
For those detained under Immigration powers (i.e. under provisions as contained within the Immigration Ordinance), please can you provide the following ; as for the last 12 month period:
(i). The number of complaints (and specifically, where deemed different, deemed 'official complaints') made by those being detained (or by 3rd parties on their behalf - including legal representatives/NGO's), whilst they are held within detention;
(ii). The number of distinct complainants involved, with reference to (i);
(iii). Further to (i) the number of complaints that relate to:
(a) conditions within detention (for e.g. hygiene/sanitary conditions; food; overcrowding; sleeping conditions; visitation arrangements; phone access; etc.)
(b) the ability to access healthcare (including medication);
(c) ability to access legal representation/NGO's;
(d) the use of force/restraint;
(e) duration/reasons for detention;
(f) body searches (including strip searches and body cavity searches).
(g) Access to/quality of interpretation;
Where possible please also provide clarification regarding how a complaint (including an official complaint) is so defined.

Dear Mr. Shaffer,
Thank you for your email of 8 January 2019 requesting information about
the number of complaints made by those being detained or by third parties
on their behalf for the last twelve-month period.
Any member of the public may lodge a complaint to the Immigration
Department to express dissatisfaction with departmental policy or service,
or the way in which the policy is implemented or the service is
delivered. I regret to inform you that we do not maintain the statistics
on the complaints made by those being detained under the Immigration
Ordinance or by the third parties on their behalf.
If we can be of assistance in the provision of other information in the
future, please do not hesitate to contact us again.
