Dear Immigration Department,

I am writing to request the following information:
• The number of non-refoulement claimants detained under immigration powers for each year from 2014 - 2019;
• The number of detained individuals who, prior to their detention, had ongoing USM claims for each year from 2014 – 2019;
• The number of detained individuals who have lodged claims within the USM during the period of their detention for each year from 2014 – 2019;

Contrary to your reply in access to information request IL/00401988/19; ImmD RM/6-5/10/2019/243(R), I am aware the Immigration Department maintains statistics on the number of non-refoulement claimants detained under immigration powers, as evidenced by information provided in SBCR 7/3221/15 Pt.8; LC Paper No. CB(2)592/18-19(01) at p.3.

Dear Ms Li,

      We refer to your application for access to information of 5 June
2020 relating to statistics on non-refoulement claims.

 

Further to our interim reply of 12 June 2020, please be informed that the
quoted information in LC Paper No. CB(2)592/18-19(01) was the number of
persons detained in the Castle Peak Bay Immigration Centre ("CIC") as at
end of November 2019.  As at 31 May 2020, 399 persons (including 79
non-refoulement claimants pending final determination of their claims)
were being detained in the CIC. The number of claimants detained varies
from time to time, depending on the changes in the circumstances of
individual cases.  The figures denoted the situation at the time of
reporting.

 

The above available statistics, however, does not contain information as
to whether the individuals had lodged their non-refoulement claims during
or prior to detention as requested in IL/00401988/19; ImmD
RM/6-5/10/2019/243(R).
