Dear Sir/Madam,

According to these news (Hot weather petition with 100,000 signatures pours heat on Hong Kong prison bosses (https://www.scmp.com/news/hong-kong/poli... Judicial review filed for female prisoners' right to wear shorts (https://www.thestandard.com.hk/breaking-...) ), the issue of prisoners’ welfare is once again in the public eye, and thus it arousing my classmates and my concern about the prisoners’ living environment. So I went to look up the relevant information but had doubts about the relevant regulations. Hence, we are going to do research based on prisoner’s living conditions and we are sincerely requesting the relevant data and information from you.

Q1. Refer to some known info about this CSD Q&A Corner Q.28, we want to know that will each PIC be provided with pre-winter materials? How will pre-winter materials (such as quilts) be distributed? And what materials is the pre-winter made of?

Q2. In what situation, the correctional service department will provide the prisoners with hot water for showers and drinking?

Q3. What is the average temperature inside the cells in every season? Refer to the article A Smart Prison — One Bite Design Studio, there are some complaints about the cells. They mentioned that the ventilation systems need to be improved. And this news aroused my concern about the temperature inside the prison cells in the summer/winter.

Q4.According to CSD Q&A corner Q86, it mentioned that each inmate will be given a daily shower for once. Could the PICs have more than one times shower a day if the temperature is very high or the prisons are very humid?

I’m eager to receive your feedback on these questions under the Code on Access to Information. Hopefully, the questions above could help us review and further discuss how to improve Prison's living conditions to create a more reasonable environment for prisoners. Dear Xiang-wei,

I refer to your application for access to information under the Code on
Access to Information ("the Code") to this Department on 2.10.2021 and our
interim reply to you on 8.10.2021.

As regards your request for information in regard to "pre-winter
materials" (such as quilts), please be informed that every person in
custody ("PIC") would be provided with a complete outfit of clothing and
blankets ("clothing items") adequate for warmth in accordance with
statutory requirements.  The clothing items would be distributed to each
PIC by the institutions.  In general, the clothing items are made of
materials including but not limited to cotton, wool, laminated fleece etc.

In respect of the provision of hot water for showers, all institutions of
CSD have installed water heaters.  Hot water of appropriate temperature
will be provided to PICs for shower according to seasonal changes and air
temperature.  Should PICs request to take additional shower, their
requests would be considered on a case-by-case basis.  Further, adequate
drinking water would be provided to PICs.

However, we do not maintain relevant information in regard to the average
temperature inside the cells in every season.  Pursuant to paragraph 1.14
of the Code, we are unable to provide the relevant information as
requested.

You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.
 Furthermore, pursuant to paragraph 1.26 of the Code, any person who
believes that a department has failed to properly apply any provision of
the Code may also complain to The Ombudsman.  The Ombudsman's address is-

We hope to seek more information about prisoner welfare and the infrastructure as well as material under cold weather. 1. Are there any principles and standards to consider for giving prisoners second times of shower? For example, the temperature of the prison is around 30 degrees celsius, will CSD allow prisoners to take additional showers?

2. If the temperature of the prison is around 13 degrees celsius, will CSD provide hot water to prisoners? How many liters of hot water will be delivered to every prisoner's hands?

3. What is the standard of adequate drinking water?

4. As for the mental health of the prisoners, except for the mental health service, do you adopt any other policies to protect the prisoners’ mental health?

As regards requests for second times of shower, persons in custody (PICs)
could raise such requests and the institutional management would consider
it on a case-by-case basis. Meanwhile, it is reiterated that hot water of
appropriate temperature will be provided to PICs for shower according to
seasonal changes and air temperature. Concerning the standard of adequate
drinking water, sufficient quantity will be readily available and provided
to the PICs with due regard to seasonal changes and their personal needs.
