貴局表示，局方並沒擁有香港公開大學的《大學發展計劃2013-2022》，並著本人自行向香港公開大學索取該文件。
《公開資料守則》第1.20段至1.23段訂明，如索取的資料是為第三者持有，局方經該第三者同意後便可披露有關資料，或者局方認為，披露資料的公眾利益超過可能造成的傷害或損害，局方仍可以披露有關資料。
本人留意到， 貴局在回應立法會議員的查詢時，需要引用香港公開大學的《大學發展計劃2013-2022》，以支持 貴局的新政策，因此披露有關文件顯然符合公眾利益。
本人認為 貴局未有符合根據《公開資料守則》第1.20段至1.23段的規定，考慮本人的索取資料要求。本人遂要求 貴局覆檢這項索取資料要求。謝謝。

謝謝你於2015年8月10日的電郵，跟進有關披露香港公開大學(“公大”)《大
學發展計劃2013-2022》的事宜。
正如本局在早前的回覆中指出，本局並沒擁有公大的《大學發展計
劃2013-2022》。不過，因應你的要求，本局已向公大索取該文件，並獲公大同意向
你提供該文件，詳見附件。公大指出，該文件只備英文版。

I have requested the Education Bureau (EDB) for the "Strategic Plan 2013–2022" of the Open University of Hong Kong (OUHK). The EDB at first claimed that the Strategic Plan was the internal document of the OUHK and the Bureau did not own the document. The EDB further added that citizens may request the document from the OUHK directly. For details, see their reply of 05.08.2015.
However, according to paragraphs 1.20 – 1.23 of the Code of Access to Information, the EDB has to consult the third party first (in this case, the OUHK) before denying my request. So I made a request for review on 10.08.2015 to the EDB and stated that the Bureau has violated paragraphs 1.20 – 1.23 of the Code.
Eventually, the OUHK has agreed to disclose their Strategic Plan and the EDB replied me with the attached document on 14.08.2015.
