I request the following documents:

- (a) Regarding the 2016-19 Triennium Planning Exercise, (i) the Advisory Letters, and (ii) the Allocation Letters issued by the UGC to the eight universities; and
- (b) Regarding the 2019-22 Triennium Planning Exercise, (i) the Planning Exercise Proposals (PEP) submitted by the eight universities in 2018;

Dear C.C. Kan,

I am writing in reply to your email of 18 April 2018 requesting access to
several documents on the strength of Government's Code on Access to
Information.

In the above email, you requested the following documents:

(a)        Regarding the 2016-19 Triennium Planning Exercise, (i) the
Advisory Letters, and (ii) the Allocation Letters issued by the UGC to the
eight universities; and

(b)        Regarding the 2019-22 Triennium Planning Exercise, (i) the
Planning Exercise Proposals (PEP) submitted by the eight universities in
2018.

On (a), I am afraid that we would be unable to accede to your request as
the advisory and allocation letters issued by the UGC to individual
UGC-funded universities are records of internal discussion and advice the
disclosure of which would inhibit the frankness and candour of discussion
of the entire process of the Academic Planning (ADP) exercise (now known
as Planning Exercise from the 2019-22 triennium).  Nevertheless, it is
worth mentioning that the results of ADP were disseminated by individual
universities internally in a way they deem fit, but the final funding
allocations to the universities are scrutinised and approved by the
Legislative Council (LegCo), and are hence available to the public through
LegCo's public records.    

On (b), the Planning Exercise Proposals (PEPs) are provided by the
universities to the UGC on the understanding that they would not be
further disclosed outside of the UGC, and they are therefore "third party
information" as defined in the Code of Access to Information.  The UGC
Secretariat is hence unable to authorise you access to those documents.

If you are not satisfied with this decision, in accordance with the
Government Code of Access to Information you may –

(a)        request an internal review of the decision by the
Secretary-General, University Grants Committee, by writing to UGC’s Access
to Information Officer as follows :
