Dear Security Bureau,

I am writing to make a data access request in relation to the Security Bureau’s Replies to initial written questions raised by Finance Committee Members in examining the Estimates of Expenditure 2021-22 (https://www.legco.gov.hk/yr20-21/english...).

In particular, I would like to understand more about the following three statistics mentioned in the document:

1) the number of recognizance holders arrested for criminal offences (SB004) [p.15-16 Table at the bottom of p.15],

2) the number arrested for unlawful employment under section 38AA of the Immigration Ordinance (SB004) [p.16], and

3) the number of illegal workers and immigration offenders (SB117) [Table on p.258]

May I know:

Are the number of recognizance holders arrested for criminal offences distinct (SB004, p. 15-16) from those arrested for unlawful employment under section 38AA IO (SB004, p.16) - i.e. are the persons accounted for in both statistics (a) separate or (b) is their overlap between them?

For those arrested for criminal offences (SB004, p. 15-16), are persons ‘double-counted’ for multiple offences or does each count account for a single person? For example, if a person was arrested on suspicion of shop theft and burglary, would that arrest be counted under the shop theft category and the burglary category, or would it be counted in only one category of offences?

Are the persons arrested for unlawful employment under section 38AA (SB004, p.16) separate from those listed in the number of illegal workers and immigration offenders (SB117, p.258), or is there any overlap between the two sets of statistics? What is the relationship between these two statistics?

Dear Ms Chopra,

I refer to your request for access to information on 27 September 2021,
please.  Further to our interim replies on 6 October 2021 and 15 October
2021, in consultation with the Immigration Department and the Police,
please find below our reply.  

The non-ethnic Chinese persons on recognizance arrested for taking up
unlawful employment contrary to section 38AA of the Immigration Ordinance
(Cap. 115) were not included in the table regarding those arrested for
criminal offences as shown in the relevant reply to the Finance Committee
(i.e. Serial No. SB004).  For compilation of the latter statistics, if a
person was arrested on one occasion for several offences, only the offence
with the heaviest maximum permissible penalty would be recorded and hence
there is no "double-counting".  

As regards the former statistics, the concerned arrestees under section
38AA formed parts of the number of illegal workers arrested in the Reply
Serial No. SB117.
