Dear Immigration Department,

I am writing to make a data access request regarding the range of conditions upon which people are granted access to bail. May I know, in each of the years between 2018-20, how many people were required to provide one or more of the following conditions:

a) the name and address of an individual that is required to stand as surety

b) a sum in bail money

c) an address.

If a CSV or Excel format is possible, I would greatly appreciate it.

Dear Raquel Amador,

 

I refer to your application for access to information received on 30 June
2021 and our interim reply of 9 July 2021.  I hereby provide you the
following information.

 

According to section 13A(2)(b) of the Immigration Service Ordinance (Cap.
331), a person who has been arrested by a member of the Service under
section 12 of Cap. 331 or any provision of the Immigration Ordinance
(Cap.115), and who has been taken to an office of the Service under
Section 13A(1)(a) of Cap. 331, may be released on bail under one of the
following three conditions:

 

(i)      on his depositing with a member of the Service such reasonable
sum of money as any member of the Service of or above the rank of
Immigration Officer may require; or

 

(ii)     on his entering into such recognizance, with such sureties, if
any, as any member of the Service of or above the rank of Immigration
Officer may require; or

 

(iii)    on his depositing such a sum of money and entering into such a
recognizance.

 

Detail statistics regarding the number of bail granted under the three
conditions as stipulated in section 13A(2)(b) of the Immigration Service
(Amendment) Ordinance (Cap. 331) in 2018, 2019 and 2020 are as below:
