Dear Ms Lu and Mr Wong,

I refer to your application for Access to Information on 28 June 2019.
 Based on information available to us, the requested information is
provided as below, please.

(i) Under the Unified Screening Mechanism, all non-refoulement claimants
may choose to receive publicly-funded legal assistance (PFLA) at the
beginning of screening of their claim by the Immigration Department
(ImmD).  Whether a non-refoulement claimant will continue to receive PFLA
at the appeal stage depends on the assessment by the lawyer providing PFLA
to the claimant on the merits of lodging an appeal, taking into account
the written decision by ImmD on the non-refoulement claim with detailed
reasons.  

During the period from Q1 2018 to Q1 2019, the TCAB received a total of 6
089 appeals, out of which 394 appeals (about 6.5%) were provided by PFLA
at the appeal stage.  

The percentage of claimants receiving PFLA on appeal out of all appeals
lodged in each of the quarters of Q1 2018 to Q1 2019 was approximately 8%,
6%, 6%, 5% and 8%.

(ii) During the period from Q1 2018 to Q1 2019, the percentage of
claimants seeking a second opinion out of all claimants whose lawyer
providing them PFLA had assessed that no PFLA should be provided to them
on appeal was approximately 1%, 1%, 1%, 1% and 4%.

(iii) During the period from Q1 2018 to Q1 2019, all claimants who
requested for a second opinion on provision of PFLA to them were provided
with the requested second opinion.

(iv) During the period from Q1 2018 to Q1 2019, the percentage of
claimants receiving PFLA on appeal upon receipt of a second opinion out of
all claimants requesting for a second opinion was about 40%, 100%, 0%, 83%
and 82%.

Dear Ms Lu and Mr Wong,

I refer to your application for Access to Information on 28 June 2019.
 Based on information available to us, the requested information is
provided as below, please.

(i) Under the Unified Screening Mechanism, all non-refoulement claimants
may choose to receive publicly-funded legal assistance (PFLA) at the
beginning of screening of their claim by the Immigration Department
(ImmD).  Whether a non-refoulement claimant will continue to receive PFLA
at the appeal stage depends on the assessment by the lawyer providing PFLA
to the claimant on the merits of lodging an appeal, taking into account
the written decision by ImmD on the non-refoulement claim with detailed
reasons.  

During the period from Q1 2018 to Q1 2019, the TCAB received a total of 6
089 appeals, out of which 394 appeals (about 6.5%) were provided by PFLA
at the appeal stage.  

The percentage of claimants receiving PFLA on appeal out of all appeals
lodged in each of the quarters of Q1 2018 to Q1 2019 was approximately 8%,
6%, 6%, 5% and 8%.

(ii) During the period from Q1 2018 to Q1 2019, the percentage of
claimants seeking a second opinion out of all claimants whose lawyer
providing them PFLA had assessed that no PFLA should be provided to them
on appeal was approximately 1%, 1%, 1%, 1% and 4%.

(iii) During the period from Q1 2018 to Q1 2019, all claimants who
requested for a second opinion on provision of PFLA to them were provided
with the requested second opinion.

(iv) During the period from Q1 2018 to Q1 2019, the percentage of
claimants receiving PFLA on appeal upon receipt of a second opinion out of
all claimants requesting for a second opinion was about 40%, 100%, 0%, 83%
and 82%.
