Dear Social Welfare Department,

We note that non-refoulement claimants who are hospitalised for extended periods have had their monthly housing allowance withheld by the International Social Service (“ISS”). Can you kindly provide information on the following:

(1) The SWD/ ISS’s policy on the provision of housing allowance to non-refoulement claimants who are hospitalised, in particular whether the SWD/ ISS's policy is to terminate or withhold housing allowance for hospitalised claimants;

(2) The number of non-refoulement claimants who have had their housing allowance terminated or withheld by the SWD/ISS due to their hospitalisation, for each 12 month period from 2014 - 2020.

Dear Ms LI,

Code on Access to Information - Application No. 29/2021

I refer to your email dated 11 February 2021, enquiring the following
information -

(a)      The policy of the Department / International Social Service
(“ISS”) on the provision of housing allowance to non-refoulement claimants
(“NRCs”) who are hospitalised, in particular whether it is the Department
/ ISS’s policy to terminate or withhold housing allowance for hospitalised
claimants; and

(b)     The number of NRCs who have had their housing allowance terminated
or withheld by the Department / ISS due to their hospitalisation, for each
12-month period from 2014 to 2020.

2.       Subsequent to our interim reply to you on 16 February 2021,
please find our reply below.

Item (a) above

3.              Since 2006, on humanitarian grounds, the Government
through open tendering has been engaging Contractor (currently the ISS –
Hong Kong Branch (“ISS-HK”)) to provide humanitarian assistance to NRCs
who are deprived of basic needs during their presence in Hong Kong so that
they will not become destitute.  As stipulated in Clause 5.1.2 of the
Service Specifications of the “Invitation to tender for administering and
delivery of assistance for NRCs”, the Contractor shall immediately cease
to provide the Services to a Service User if any of the following occurs –

(a)      notification by the Service User that the Services are no longer
required;

(b)     the Service User has been transferred to another Contractor or is
found to have received the Services from another Contractor;

(c)      notification from the Government Representative that the Services
to the Service User are to be ceased;

(d)     the Service User is assessed by the Contractor to be no longer
eligible for or in need of the Services;

(e)      the Service User has obtained similar services to the Services
from other sources;

(f)      the Service User leaves Hong Kong;

(g)     the Service User passed away; or

(h)     subject to the Contractor having obtained the Government’s prior
written consent, other reasons as the Contractor deems just.

Based on Clause 5.1.2 (e) as above, accommodation assistance to Service
User who is hospitalised may be subject to suspension or termination;
subsequent to the Contractor’s assessment on his/her needs and medical
proof on his/her expected duration of hospitalisation from case medical
officer(s) of the public hospital, if any.

Item (b) above

4.              The Department does not have information on the number of
NRCs who have had their accommodation assistance terminated or withheld by
the ISS-HK due to their hospitalisation for each 12-month period from 2014
to 2020.

may have information on the number of non-refoulement claimants (“NRCs”)
who have had their housing allowance terminated or withheld due to their
hospitalisation.

2.                 To the Department’s knowledge, other government
departments and the non-government organisation which has been
commissioned to provide humanitarian assistance to the NRCs do not have
the abovementioned statistics.
