Dear Social Welfare Department,

I am writing to make an information request regarding migrant children held at Tuen Mun Children and Juvenile Home (“TMCJH”). May I know,

1) What are the reasons for migrant children (ie. non-local children) to be held in TMCJH?
2) In 2020, what were the reasons (ex. Sections under the Immigration Ordinance, or other as applicable) for 24 migrant children to be admitted to TMCJH?

information regarding migrant children held at Tuen Mun Children and
Juvenile Home ("TMCJH").  Our reply is as follows:
 
TMCJH serves as a place of refugee providing temporary custody for illegal
immigrants aged under 18 according to Section 4 of the Immigration (Places
of Detention) Order (Chapter 115B).  The 24 migrant children that you
mentioned are under the arrangement of this Order.

I would like to clarify: Does the Social Welfare Department maintain information on the reason of holding migrant children in TMCJH? Namely, sections of the Immigration Ordinance (Cap. 115)- for example children who are held under Section 31 (Detention of deportee for inquiries) or Section 32 (Detention pending removal or deportation), and so on.

Further, may I know, does the Social Welfare Department maintain statistics on how many migrant children held at TMCJH have their parents / carers in Hong Kong or whether they are unaccompanied in Hong Kong?

information regarding migrant children held at Tuen Mun Children and
Juvenile Home ("TMCJH").  Our reply is as follows:
The Social Welfare Department ("SWD") does not have any information
regarding the reason(s) of detention with regard to cases detained in
TMCJH under the Immigration Ordinance, Chapter 115.  SWD also does not
have any information regarding the detained children's parents or carers,
or whether or not these children are unaccompanied in Hong Kong.
