I am writing to enquire, as of 31 March 2018, how many non-refoulement claimants, having their claims been finally determined and rejected by the Immigration Department, (i) had lodged appeals/petitions or were within the 14-day period for lodging appeals/petitions; (ii) had not lodged appeals/petitions, were without the 14-day period for lodging appeals/petitions and were in Hong Kong; (iii) had left or were deported or removed from Hong Kong; and (iv) were pending removal.

Thank you for your email enquiry of 28 May 2018 enquiring about the number
of non-refoulement claimants in Hong Kong.

 

Further to our interim reply on 15 June 2018, please be informed that as
of 31 March 2018, among the non-refoulement claims rejected by the
Immigration Department (“ImmD”) under the Unified Screening Mechanism
(“USM”), around 6 200 claimants had lodged an appeal or were those who are
within the 14-day time limit for lodging an appeal,  4 000 claimants had
left Hong Kong or were pending removal, and removal arrangement for the
remaining 1 500 claimants would be made in due course. The ImmD does not
have further breakdown for the question (ii) in your e-mail.

removal arrangements were made for claimants who were pending removal
while the latter refers to those who are still in Hong Kong for other
reasons like being imprisoned, being prosecuted or having applied for
judicial review, etc. whose removal arrangements would be made in due
course.
