I would like to know the number of non-refoulement claimants whose claims were substantiated by your Department or the Torture Claims Appeal Board/ the number of asylum seekers whose claims were established by UNHCR before the commencement of the Unified Screening Mechanism who left Hong Kong for resettlement in a country other than a torture or persecution risk State in each of the calendar years from 2009 to 2017.

Dear Ms Li,

 

Thank you for your email enquiries of 4 October 2017 and another email of
6 October 2017 enquiring about the number of non-refoulement claimants in
Hong Kong.  Further to our interim replies on 13, 25 and 26 October 2017,
our consolidated reply is as follows.

 

As at end September 2017, among the 9 451 non-refoulement claims
determined under the unified screening mechanism (USM), 79 were
substantiated (including 17 claims substantiated by the Torture Claims
Appeal Board on appeal).  Among the claims rejected by the Immigration
Department (ImmD), 5 669 claimants have lodged an appeal or are those who
are within the 14-day time limit for lodging an appeal, 2 538 claimants
have left Hong Kong or are pending removal, and removal arrangement for
the remaining 1 165 claimants will be made in due course.  In addition, 24
torture claims were substantiated under the enhanced administrative
mechanism since December 2009 before commencement of the USM.  ImmD is not
in a position to provide figures relating to UNHCR’s work, including
resettlement.

 

The ImmD has committed to remove all unsubstantiated claimants from Hong
Kong as soon as possible.  From 2014 to 2016, a total of 1 394
unsubstantiated claimants (including torture claimants before the
commencement of USM) were removed from Hong Kong.  In the first 9 months
of 2017, 888 unsubstantiated claimants had been repatriated. The ImmD does
not maintain further breakdown of the statistics by nationalities for the
requested period, while the most common countries for repatriation of
unsubstantiated claimants are from South Asian and Southeast Asian
Regions.
