Dear Ms Li,

        I refer to your request for Access to Information on 16 June 2020.
 In consultation with the Torture Claims Appeal Board (TCAB) and the
Immigration Department (ImmD), the information is provided as below,
please.

2.        As at 31 May 2020, 19 198 appeals/petitions have been filed with
TCAB/Non-refoulement Claims Petitions Office against the Director of
Immigration's decision on non-refoulement claims.  Among them, 2 403
appeals/petitions are pending decision by TCAB.

3.        As at 31 May 2020, there are 245 claims pending screening by
ImmD.  Under the prevailing policy, ImmD will temporarily suspend the
removal of any persons (including non-refoulement claimants) from Hong
Kong if relevant court proceedings have commenced or are about to
commence.  According to the records of ImmD, around 7 600 unsuccessful
claimants whose claims have been rejected under the Unified Screening
Mechanism have applied to the court for leave for judicial review (JR) or
for JR.  Besides, around 2 800 other unsuccessful claimants remained in
Hong Kong as they were imprisoned, remanded, involved in ongoing criminal
investigation process, absconded or because of some other reasons, or were
waiting for repatriation arrangements.
