Dear Correctional Services Department,
I am writing to make a data access request about number of physical confrontations at Tai Tam Gap Correctional Institution. May I know, for each month from the start of its recommissioning as a detention centre until the last day of September 2021,
1) The number of cases of physical confrontation involving detainees,
a) the number of detainees who were involved in such physical confrontations
b) the number of detainees who were injured as a result of such physical confrontations
c) the number of staff who were injured as a result of such physical confrontations
2) The nature of such physical confrontation at the Tai Tam Gap Correctional Institution, including:
a) Detainee-on-detainee assaults
b) Detainee-on-staff assaults
c) Others (please specify)
3) The number of cases in which immigration officers used force on immigration detainees
4) The reason for immigration officers to use force on immigration detainees, including:

Dear Raquel Amador,
I refer to your application for access to information under the Code on
Access to Information (“the Code”) to this Department on 12.10.2021 and
our interim replies to you on 21.10.2021 and 1.11.2021.
The relevant statistical figures are listed as below:-
• 7 cases of physical confrontation involving persons in custody between
28 May 2021 and 30 Sep 2021 at Tai Tam Gap Correctional Institution
(“TGCI”);
• 16 persons in custody were involved in physical confrontation between 28
May 2021 and 30 Sep 2021 at TGCI;
• 6 persons in custody were injured as a result of physical confrontation
between 28 May 2021 and 30 Sep 2021 at TGCI;
• No staff of CSD was injured as a result of physical confrontation
between 28 May 2021 and 30 Sep 2021 at TGCI;
• 1 case of physical confrontation was reported to the Police between 28
May 2021 and 30 Sep 2021 at TGCI;
• 1 case of self-harm by person in custody between 28 May 2021 and 30 Sep
2021 at TGCI; and
• CSD Regional Response Team had not been deployed to handle cases of
physical confrontation between 28 May 2021 and 30 Sep 2021 at TGCI.
The CSD is currently supervising persons in custody who have committed
serious crimes, pose security risks and are at risk of absconding or
reoffending at TGCI in accordance with the relevant legislation.
On the other hand, the institutional management would report cases of
physical confrontation to the Police having regard to the gravity of the
cases. Further, persons in custody may also request for assistance from,
making reports to, or to be seen by Police with or without disclosing the
reasons behind.
However, we do not maintain the following statistical figures:-
• The total number of admission of person in custody as at 30.9.2021 at
TGCI;
• The number of person in custody put into solitary confinement per month
at TGCI;
• The total number of person in custody put into solitary confinement as
at 30.9.2021 at TGCI; and
• The duration (in days) of solitary confinement of each person in custody
at TGCI.
Pursuant to paragraph 1.14 and 2.9(d) of the Code, we are unable to
provide the relevant information as requested.
As regards the statistical figures:-
• The number of use of force cases by Immigration officers on persons in
custody at TGCI;
• The reason for use of force by Immigration officers on persons in
custody at TGCI; and
• The type of force used on persons in custody at TGCI.
Please be informed that we do not possess the aforesaid statistical
figures, pursuant to paragraph 1.14 of the Code, we are unable to provide
the relevant information as requested.
You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.

Dear Raquel Amador,
I refer to your application for access to information under the Code on
Access to Information (“the Code”) to this Department on 12.10.2021 and
our interim replies to you on 21.10.2021 and 1.11.2021.
The relevant statistical figures are listed as below:-
• 7 cases of physical confrontation involving persons in custody between
28 May 2021 and 30 Sep 2021 at Tai Tam Gap Correctional Institution
(“TGCI”);
• 16 persons in custody were involved in physical confrontation between 28
May 2021 and 30 Sep 2021 at TGCI;
• 6 persons in custody were injured as a result of physical confrontation
between 28 May 2021 and 30 Sep 2021 at TGCI;
• No staff of CSD was injured as a result of physical confrontation
between 28 May 2021 and 30 Sep 2021 at TGCI;
• 1 case of physical confrontation was reported to the Police between 28
May 2021 and 30 Sep 2021 at TGCI;
• 1 case of self-harm by person in custody between 28 May 2021 and 30 Sep
2021 at TGCI; and
• CSD Regional Response Team had not been deployed to handle cases of
physical confrontation between 28 May 2021 and 30 Sep 2021 at TGCI.
The CSD is currently supervising persons in custody who have committed
serious crimes, pose security risks and are at risk of absconding or
reoffending at TGCI in accordance with the relevant legislation.
On the other hand, the institutional management would report cases of
physical confrontation to the Police having regard to the gravity of the
cases. Further, persons in custody may also request for assistance from,
making reports to, or to be seen by Police with or without disclosing the
reasons behind.
However, we do not maintain the following statistical figures:-
• The total number of admission of person in custody as at 30.9.2021 at
TGCI;
• The number of person in custody put into solitary confinement per month
at TGCI;
• The total number of person in custody put into solitary confinement as
at 30.9.2021 at TGCI; and
• The duration (in days) of solitary confinement of each person in custody
at TGCI.
Pursuant to paragraph 1.14 and 2.9(d) of the Code, we are unable to
provide the relevant information as requested.
As regards the statistical figures:-
• The number of use of force cases by Immigration officers on persons in
custody at TGCI;
• The reason for use of force by Immigration officers on persons in
custody at TGCI; and
• The type of force used on persons in custody at TGCI.
Please be informed that we do not possess the aforesaid statistical
figures, pursuant to paragraph 1.14 of the Code, we are unable to provide
the relevant information as requested.
You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.

Dear Raquel Amador,
I refer to your application for access to information under the Code on
Access to Information (“the Code”) to this Department on 12.10.2021 and
our interim replies to you on 21.10.2021 and 1.11.2021.
The relevant statistical figures are listed as below:-
• 7 cases of physical confrontation involving persons in custody between
28 May 2021 and 30 Sep 2021 at Tai Tam Gap Correctional Institution
(“TGCI”);
• 16 persons in custody were involved in physical confrontation between 28
May 2021 and 30 Sep 2021 at TGCI;
• 6 persons in custody were injured as a result of physical confrontation
between 28 May 2021 and 30 Sep 2021 at TGCI;
• No staff of CSD was injured as a result of physical confrontation
between 28 May 2021 and 30 Sep 2021 at TGCI;
• 1 case of physical confrontation was reported to the Police between 28
May 2021 and 30 Sep 2021 at TGCI;
• 1 case of self-harm by person in custody between 28 May 2021 and 30 Sep
2021 at TGCI; and
• CSD Regional Response Team had not been deployed to handle cases of
physical confrontation between 28 May 2021 and 30 Sep 2021 at TGCI.
The CSD is currently supervising persons in custody who have committed
serious crimes, pose security risks and are at risk of absconding or
reoffending at TGCI in accordance with the relevant legislation.
On the other hand, the institutional management would report cases of
physical confrontation to the Police having regard to the gravity of the
cases. Further, persons in custody may also request for assistance from,
making reports to, or to be seen by Police with or without disclosing the
reasons behind.
However, we do not maintain the following statistical figures:-
• The total number of admission of person in custody as at 30.9.2021 at
TGCI;
• The number of person in custody put into solitary confinement per month
at TGCI;
• The total number of person in custody put into solitary confinement as
at 30.9.2021 at TGCI; and
• The duration (in days) of solitary confinement of each person in custody
at TGCI.
Pursuant to paragraph 1.14 and 2.9(d) of the Code, we are unable to
provide the relevant information as requested.
As regards the statistical figures:-
• The number of use of force cases by Immigration officers on persons in
custody at TGCI;
• The reason for use of force by Immigration officers on persons in
custody at TGCI; and
• The type of force used on persons in custody at TGCI.
Please be informed that we do not possess the aforesaid statistical
figures, pursuant to paragraph 1.14 of the Code, we are unable to provide
the relevant information as requested.
You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.

confrontations

Further to our interim reply on 31.12.2021, it is reiterated that CSD
Regional Response Team had not been deployed to handle cases of "physical
confrontation" between 28 May 2021 and 30 Sep 2021 at TGCI. CSD would
conduct assessment with due regard to operational and security factors in
deploying members of the Regional Response Team in response to incidents
at institutions. As regards statistics on solitary confinement, we do not
maintain such statistical figures pursuant to para. 1.14 and 2.9(d) of the
code.
