Request for Information Related to Measures against Human Trafficking
Dear Labour Department,
Hope all is well. I am Yue Teng. Me and my friends came to know that there has recently been an increasing number of rescue calls from Hong Kong individuals who were allegedly trafficked to Southeast Asia.
1.Therefore, for our information request, we would like this Department to provide detailed information related to how this Department, the immigration office, the C&E Department and the police force collaborate to help out those people who were allegedly trafficked from or to Hong Kong. We would be grateful if you can also clarify the differences between the policies of the aforementioned departments in terms of standard protocols or procedures when conducting TIP assessments. In particular, we would also be grateful if you can explain how cases involving human trafficking are allocated between different departments and their respective screening methods (such as guidelines or common practices).
We do understand that this Department may not possess information that involve or belong to other departments. In that case, please let us know and provide those requested information that this Department has access to only.

clarification in relation to one of your quoted reference numbers of the

According to the disclosure log of the Labour Department (LD), there is no
record of AIO 3/202 as quoted in your email. However, a similar reference
number, AIO 3/2021 on information of the Trafficking-in-Persons
assessments is available. In this connection, we should be most grateful
for your clarification on whether you would like to be provided with
information released under reference number of AIO 3/2021 as well as AIO
104/2020, AIO 52/2021 and AIO 55/2021 of the disclosure log of LD.

Thank you for your email requesting for information on the Labour
Department (LD)’s work relating to trafficking in persons (TIP) and the
information released under the quoted reference numbers of LD’s disclosure
log as relayed by the Labour and Welfare Bureau (LWB) and clarified by
you. You gave consent for LWB to transfer your request to LD for handling
on 1 November 2022 and wrote separately to LD for the same request on the
same day. Further to our acknowledgement reply on 3 November 2022 and
further clarification with you on 7 November 2022, the information
requested is provided in the ensuing paragraphs.
Pursuant to the “Action Plan to Tackle TIP and to Enhance Protection of
Foreign Domestic Helpers (FDHs) in Hong Kong” (the Action Plan)
promulgated by the Government of the Hong Kong Special Administrative
Region in March 2018, LD has since 16 December 2019 implemented an initial
victim screening mechanism in its ten Labour Relations Division (LRD)
branch offices to identify at an early stage FDHs and other vulnerable
persons who might potentially be more prone to being exploited or abused.
Making reference to the questionnaire adopted by other relevant Government
authorities, a standard questionnaire with a list of indicators/parameters
is adopted among the LRD branch offices. When the indicator(s) is
triggered, the cases will be referred to law enforcement agencies for
conducting full debriefing and follow up actions at the earliest possible
time as needed.
Regarding the assistance provided to TIP victims, you may wish to refer to
the Action Plan and contact the relevant Government departments for
further information.
