Dear Hong Kong Police Force Operations Wing,

I am writing to make official requests for the following information.

In relation to the mandatory requirement to use LeaveHomeSafe mobile app under the Prevention & Control of Disease (Requirements & Directions) (Business & Premises) Regulation):

1. The number of restaurants inspected by the police since its implementation on 9 December 2021
2. The number of prosecutions/warnings/fine tickets issued against restaurants for failing to ensure their customers scanned the LeaveHomeSafe mobile app since its implementation on 9 December 2021
3. The number of prosecutions/warnings/fine tickets issued against restaurant customers for failing to scan the LeaveHomeSafe mobile app since its implementation on 9 December 2021
4. Whether the police has received any complaints about selectively/wrongfully prosecuting or issuing warning/fine tickets to restaurants/customers; if yes, please provide statistics on the number, detail of such complaints and follow-up action (if any) taken by the authority.

Dear Ms Wai,

I refer to your request of 2022-04-18 and append below our responses to
the questions raised:

Question 1
As at 2022-04-24, 4 474 restaurants have been inspected by the Police in
relation to the mandatory requirement to use LeaveHomeSafe mobile app
under the Prevention & Control of Disease (Requirements & Directions)
(Business & Premises) Regulation.

Questions 2 & 3
As at 2022-04-24, the number of prosecutions/warnings/fine tickets issued
against restaurant persons-in-charge or customers for failing to ensure
scan of QR Code or to scan QR code by using the LeaveHomeSafe mobile app
since its implementation on 9 December 2021 is as follows -

Fixed Penalty Notice:         212
Prosecution:                         47

Question 4
As at 2022-03-31, there are 51 applications for withdrawal of Fixed
Penalty Notice and two of which were withdrawn after review.

If you consider that this Department has not properly applied any
provision of the Code, you may file an internal review or complain direct
