Dear Charlie,
I refer to the four applications for access to information submitted by
you on 12 January 2021 to various bureau/departments, including the
Security Bureau (“SB”), Customs and Excise Department, Immigration
Department (“ImmD”) and Labour Department (“LD”), in relation to the
protocols and procedures of Trafficking in Persons (“TIP”) screenings and
handling of TIP cases.  Further to the interim replies, this is a
consolidated reply on behalf of the above mentioned bureau/ departments.

As per your request in April 2020, we already provided you with a copy of
the “Revised Guideline on Inter-departmental Cooperation for the Handling
of Suspected Cases of Trafficking in Persons” which sets out the
principles, procedures and other information on the handling of suspected
TIP cases, including the coordination among relevant departments.  

Separately, the Action Plan to Tackle TIP and to Enhance Protection of
Foreign Domestic Helpers (“the Action Plan”) was promulgated in March 2018
and all 34 initiatives in the Action Plan have already been implemented by
end 2019.  Since December 2019, the initial screening mechanism was
further extended to cover foreign domestic helpers (“FDHs”) seeking
assistance from LD at the 10 branch offices of its Labour Relations
Division across the territory such that FDHs potentially being exploited
or abused can be identified at an early stage, and those possibly facing
greater dangers (e.g. being physically abused) can be referred to law
enforcement agencies (“LEAs”) at the earliest possible time as needed.  A
standard questionnaire with a list of indicators/parameters is adopted so
as to ensure a standardised approach with LEAs in identifying potential
victims of TIP.  Also, ImmD has set up a dedicated team in December 2019
to step up the checking of records on all FDH visa applications.  All
applicable entry visa and post-entry visa applications of FDHs would be
subject to screening by the new team, with a view to identifying potential
TIP victims at an early stage.
