Transfers from Tai Tam Gap Correctional Institution
Dear Correctional Services Department,
I am writing to make a data access request about transfers from Tai Tam Gap Correctional Institution to other institutions. May I know for each month from the start of its recommissioning as a detention centre until the last day of September 2021,
A) The number of persons transferred to other immigration detention or CSD institutions
i) per month
ii) in total
B) The immigration detention or CSD institutions they were transferred to
C) For how long each person was transferred to other immigration detention or CSD institutions
D) What are the criteria for transferring a detainee to other immigration detention or CSD institutions
If a CSV or Excel format is possible for the statistical data, I would greatly appreciate it.

Dear Sir/ Madam,
I refer to your application for access to information under the Code on
Access to Information (“the Code”) to this Department on 15.10.2021 and
our interim replies to you on 22.10.2021 and 4.11.2021.
As regards the criteria for transferring a person in custody to
Immigration detention centres or other CSD institutions from Tai Tam Gap
Correctional Institution (“TGCI”), all persons in custody would be
assigned to the foregoing facilities with due regard to their personal
circumstances, rehabilitative needs as well as other relevant factors,
such as security and operational considerations.
However, we do not maintain the following statistical figures: -
- The number of persons in custody transferred to Immigration detention
centres or other CSD institutions per month from TGCI since its
recommission to the end of September 2021;
- The total number of persons in custody transferred to Immigration
detention centres or other CSD institutions from TGCI since its
recommission to the end of September 2021;
- The Immigration detention centres or other CSD institutions the persons
in custody were transferred to from TGCI since its recommission to the end
of September 2021; and
- For how long each person in custody was transferred to Immigration
detention centres or other CSD institutions from TGCI since its
recommission to the end of September 2021.
Pursuant to paragraph 1.14 and 2.9(d) of the Code, we are unable to
provide the relevant information as requested.
You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.
Furthermore, pursuant to paragraph 1.26 of the Code, any person who
believes that a department has failed to properly apply any provision of
