Dear Immigration Department,

For each 12 month period from 01 March 2014 (beginning), to 31 March 2018 March (end of Q1), ["the relevant period"], regarding the following:

i) No. of USM claims made/submitted in the relevant period;
(ii) No. of written significations submitted/received;
(iii) No. of written significations accepted;
(iv) No. of USM claims determined at First Instance (i.e. by the Immigration Department/Director of Immigration);
(v) No. of USM claims recognized/refused at First Instance;
(vi) No. of appeals lodged to the TCAB;
(vii) No. of appellants with legal representation at appeal;
(viii) No. of appeals determined;
(vix) No. of appeals granted/refused;
(vx) No. of appeals outstanding.

Thank you for your email enquiry of 6 May 2018 enquiring about the number
of non-refoulement claimants in Hong Kong. 

 

Further to our interim reply on 25 May 2018, please be informed that the
statistics on non-refoulement claims, including the numbers of claims
made, determined and substantiated, are available on the website of the
Immigration Department (“ImmD”):

A person who claims non-refoulement protection in Hong Kong must signify
to an immigration officer in writing his intention to seek non-refoulement
protection. The written signification must give a general indication of
the person’s reasons for claiming non-refoulement protection and once a
claim is made, it will be screened on all applicable grounds.  Apart from
the number of made claims, the ImmD does not maintain figures in relation
to written signification.

 

As regards the Torture Claims Appeal Board (“TCAB”), based on information
from TCAB, the numbers of appeals lodged to the TCAB, determined and
outstanding are tabulated below:

Upon receipt of the notice of decision issued by the Director of
Immigration, the duty lawyer would assess and decide whether legal
assistance should be provided to his/her claimant during the
appeal/petition proceedings. At present, about 9% of the
appellants/petitioners are legally represented.
