Clarification of Torture Claims Appeal Board statistics

Scott Edmunds made this Freedom of Information request to Security Bureau

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Security Bureau,

I recently received statistics from you on the number of appeals to the Torture Claims Appeal Board (Non-refoulement Claims Petition Office), and of the number of cases substantiated. See:

https://accessinfo.hk/en/request/statist...

Of these TCAB statistics can I ask for further detail on:

1. The number of decisions of the TCAB challenged via Judicial Review applications lodged in the High Court.

2. The number of appeals for which the appellant is not legally represented at the TCAB.

3. The number of appeals for which there is no representative from the Director of Immigration present at the hearing?

4. For each listed member of the TCAB (i.e. By name from this list http://www.sb.gov.hk/eng/links/tcab/) can I also get access to the following information:

(i) number of appeals he/she has heard within the last 12 months;
(ii) the number of written determinations/decisions he/she has given in that time; and the average time from hearing to written decision.
(iii) the number of cases accepted/refused by that member within this time frame;
(iv) the number of his/her decisions challenges via consequent applications for JR; and
(v) the number of those JR applications which were [successful/unsuccessful; ].
(vi) any complaints received against the judge and whether they were upheld.

This may take some time, so I'm happy to receive the information from points 1-3 first.

Yours faithfully,

Scott Edmunds

Security Bureau
