Maintaining social distancing is key to prevent and delay the spread of
the coronavirus disease 2019 (COVID-19) within the community in Hong Kong.
 Since the outbreak of COVID-19 in early 2020, the Government has been
adjusting our social distancing measures having regard to the development
of the epidemic situation, risk assessment and experts' advice.  In
deciding the social distancing measures to be put in place, the Government
has also balanced the oft-competing factors of public health protection,
economic impact and social acceptance.  

The Prevention and Control of Disease (Wearing of Mask) Regulation (Cap.
599I) came into effect since July 2020, providing the legal basis for the
Government to impose a mandatory mask-wearing requirement for a specified
period for the purposes of preventing, protecting against, delaying or
otherwise controlling the incidence or transmission of the specified
disease.  In formulating the mandatory mask-wearing requirement, we have
taken into account the experts' advice and the World Health Organization
(WHO)'s advice in respect of the wearing of mask.  According to WHO's
guidance titled "Mask Use in the Context of COVID-19" published on 5 June
2020 and subsequently updated on 1 December 2020 (at
[1]https://www.who.int/publications/i/item/...),
WHO advises the use of masks as part of a comprehensive package of
prevention and control measures to limit the spread of COVID-19, along
with other infection prevention and control measures include hand hygiene,
physical distancing of at least 1 metre, testing, contact tracing,
quarantine and isolation etc.  Masks can be used either for protection of
healthy persons or for source control to prevent onward transmission.
 Together these measures are critical to prevent human-to-human
transmission of COVID-19.  In addition, the WHO urges fully vaccinated
people to continue wearing masks and taking other preventive measures as
it is still not known about the extent to which COVID-19 vaccine keeps
people from being infected and passing the virus to others. The relevant
advice is available at

Although the epidemic situation in Hong Kong has become more stable
recently, the epidemic situation worldwide remains severe.  We must remain
cautious amidst  threats of the highly contagious Delta variant across the
globe.  In fact, Hong Kong continues to record imported cases carrying
variants of concern from time to time.  Overseas experiences also suggest
that the risk of an explosive community outbreak and rebound of the
epidemic situation is considerably high following drastic relaxations of
social distancing measures.  Against the foregoing, the mandatory
mask-wearing requirement under Cap. 599I has been extended until 4 August
2021 to prevent a rebound of the epidemic situation locally.    

The Government will continue to review and adjust the social distancing
measures including the mask-wearing requirement from time to time, having
regard to, inter alia, the development of the epidemic situation, risk
assessment and experts' advice.

I have asked specifically which studies you are following that shows that mask wearing stops transmission of viruses and along with a risk/ benefit analysis that overall proves they are beneficial. So far no studies have been provided. I also asked when we will be able to stop wearing masks?

While the local epidemic situation is stable, the global pandemic
situation remains severe.  COVID-19 mutant strains including the latest
Omicron are spreading rapidly around the world.  In particularly, there
are increasing scientific evidences showing that the Omicron strain has a
higher transmissibility than the other variants of concern.  We must stay
vigilant and adopt stringent epidemic control measures to follow through
on the anti-epidemic strategy of guarding against the importation of cases
and the resurgence of domestic infections in order to attain the goal of
dynamic 'zero infection'.  
 
As of 15 December 2021, Hong Kong has already detected nine COVID-19 cases
carrying the Omicron strain.  While the local vaccination rate has reached
70%, it has yet to reach the level required to prevent imported cases from
spreading in the local community.  The current stable epidemic situation
would not be possible without the comprehensive anti-epidemic measures
from all fronts, including wearing of mask by the general public,
quarantine of inbound travelers and compulsory testing on persons with
high risk of infection etc. The Government must maintain and even step up
the necessary anti-epidemic measures to guard against COVID-19 cases
especially those carrying Omicron from importing into Hong Kong and, worse
still, causing a community outbreak.  
 
As advised in the World Health Organization (WHO)’s relevant guidance
(available at
[1]https://www.who.int/publications/i/item/...),
the use of masks should be adopted as part of a comprehensive package of
prevention and control measures to limit the spread of COVID-19, along
with other infection prevention and control measures include hand hygiene,
physical distancing of at least 1 metre, testing, contact tracing,
quarantine and isolation etc.  Under the current severe global pandemic
situation which is aggravated by the rapidly spreading Omicron strain, the
use of masks is a necessary integral part of the Government’s overall
anti-epidemic measures.  
 
Having regard to the above WHO’s guidance, higher transmissibility of
Omicron and other variants in circulation such as Delta, public health
risk assessment, feasibility of mandatory wearing of mask and the local
context etc., the Government considers that the mandatory mask-wearing
requirement should be maintained under the current public health
emergency.  The measure is of paramount importance in preventing the
spread of the virus in the local community, which could take a heavy toll
on human lives, our public healthcare system and the economy.
 
The Government will continue to review and adjust the social distancing
measures including the mask-wearing requirement from time to time, having
regard to, inter alia, the development of the epidemic situation, risk
assessment and experts' advice.

Your email dated 19 December 2021 to the Department of Health has been
referred to the Food and Health Bureau.  Please find our responses in the
ensuing paragraphs.

 

The Prevention and Control of Disease (Wearing of Mask) Regulation (Cap.
599I) came into effect on 15 July 2020.  Pursuant to Cap. 599I, during a
period of not more than 14 days as specified by the Secretary for Food and
Health by notice published in the Gazette (the specified period), a person
must wear a mask at all times when the person is boarding or on board a
public transport carrier, is entering or present in an MTR paid area, or
is entering or present in a specified public place (i.e. all public
places, save for outdoor public places in country parks and special areas
as defined in section 2 of the Country Parks Ordinance (Cap. 208) in
accordance with the latest specification).  The mandatory mask-wearing
requirement under Cap. 599I has been extended to the specified period of
23 December 2021 to 5 January 2022.  In other words, the mask-wearing
requirement in the aforementioned places is a statutory requirement.  

 

Under Cap. 599I, if a person does not wear a mask in accordance with the
requirement, an authorised person may deny that person from boarding a
public transport carrier or entering the area concerned, as well as
require that person to wear a mask and disembark from the carrier or leave
the said area.  A person in contravention of the relevant provision
commits an offence and the maximum penalty is a fine at level 3
($10,000).  In addition, authorised public officers may issue fixed
penalty notices to persons who do not wear a mask in accordance with the
requirement and such persons may discharge liability for the offence by
paying a fixed penalty of $5,000.

Firstly the WHO link cannot be found.

-Please advise the number of recent community outbreaks that would

necessitate the 'protection' of a mask?When will the mask wearing mandate

be rescinded? Under what conditions?
