Dear Allyson van de Pol,
                I refer to your email dated 12.9.2023 requesting for an
internal review of your request for information under the Code on Access
to Information (the Code) concerning records of recent testing of the
compounds/ minerals/ chemicals found in the soil across Hong Kong.  The
Department has considered your review request and our reply is stated
below.

2.                In response to your request for information concerning
records of recent testing of the compounds/ minerals/chemicals found in
the soil across Hong Kong under the Code made on 29.8.2023, we replied on
31.8.2023 that we do not possess the requested information.  After receipt
of your review request, we have re-examined the information you requested
and concluded that we do not possess the requested information as stated
in paragraph 1 above as no soil testing across Hong Kong has been
conducted by the Department.  In accordance with paragraph 1.14 of the
Code as extracted below, the Government is not obliged to create a record
which does not exist.

                Para.1.14 of the Code
                1.14        The Code does not oblige departments to
                -        acquire information not in their possession
                -        create a record which does not exist
                -        provide on request information which is already
published, either free or at a charge, or
                -        provide information available through an existing
charged service.
                In these circumstances, an applicant for information will,
where possible, be directed to the appropriate source of the information.

3.                While the Department does not possess the information
you requested, there is information in the public domain which you may
wish to refer to

4.                If you are not satisfied with the above review result,
you may lodge a complaint to the Ombudsman with the following contact
