'The privacy issue of the prisoners'
Dear Privacy Commissioner for Personal Data,
I am writing to seek information about the government program-Smart Prison and other information about the complaint mechanism. I refer to the document released on PCPD's Guidance on the Ethical Development and Use of Artificial Intelligence. It pointed out that the organizations may consider the risk factors, like the sensitivity of the data used. And CSD has implemented the program of Smart Prison and installed CCTV in the toilet which may involve privacy problems. Hence, we are going to do research about Smart Prison’s privacy problems.
Here are the questions for the department to answer under the Code on Access to Information.
Q 1. Have the Correctional Service Department (CSD) consulted the privacy commission about the Smart Prison Programme regarding the privacy rights of the PICs (Person in Custody)?
Q 2. Based on the above questions, In what ways is the CSD treated differently in the Personal Data (Privacy) Ordinance? Does the department enjoy any privilege when handling the personal data of PICs? If yes, how about installing CCTV in the toilets watching the prisoners while they are using the toilet?
Q3. Do your department receive any complaints about Smart prison? Can you give us some example cases, and how you reflect the complaints to CSD?
I hope the Privacy Commission could look into this matter and answer these questions under the Code on Access to Information. Hopefully, the questions above could help us review and further discuss how the program of Smart Prison could be improved to better protect and concerns about privacy rights. You may wish to know that my students are
taking a General Education course through which they investigate various
government policies and projects. Smart Prison project is one of them
being studied this semester. The students then write letters to the editor
in SCMP (see letters we

these projects and share their research findings. Since the Commissioner
and the CSD refuse to provide info regarding the privacy issues, we would
have no choice but to write in SCMP to urge the government to be more
transparent about these matters (e.g. we made a similar transparency
argument about the Department of Justice

Given the special/sensitive nature of this issue (prisoners being a
particularly vulnerable group in our society), we believe the authorities
and those in power should be more cautious when imposing the smart prison
system on these people. If the staff at the Privacy Commission believe in
the importance of protecting people's privacy including prisoners' rights,
I think you should be more forthcoming in sharing information or at least
offer us more suggestions on what can be done to better protect the
privacy of these groups of people. Legally you are not necessarily
obliged to do so; but morally and ethically you should.
From time to time I write to the government
staff in a rather aggressive tone; but fundamentally I believe the
government is on our side as we all try to make our society a better
place. To do that we should have an open conversation for which
transparency is essential.

You may wish to know that my students are
taking a General Education course through which they investigate various
government policies and projects. Smart Prison project is one of them
being studied this semester. The students then write letters to the editor
in SCMP (see letters we

these projects and share their research findings. Since the Commissioner
and the CSD refuse to provide info regarding the privacy issues, we would
have no choice but to write in SCMP to urge the government to be more
transparent about these matters (e.g. we made a similar transparency
argument about the Department of Justice

Given the special/sensitive nature of this issue (prisoners being a
particularly vulnerable group in our society), we believe the authorities
and those in power should be more cautious when imposing the smart prison
system on these people. If the staff at the Privacy Commission believe in
the importance of protecting people's privacy including prisoners' rights,
I think you should be more forthcoming in sharing information or at least
offer us more suggestions on what can be done to better protect the
privacy of these groups of people. Legally you are not necessarily
obliged to do so; but morally and ethically you should.
From time to time I write to the government
staff in a rather aggressive tone; but fundamentally I believe the
government is on our side as we all try to make our society a better
place. To do that we should have an open conversation for which
transparency is essential.

1. What is the procedure of prisoners' complaints about their privacy
issues in prison?
2. Refer to the reply from you, you mentioned that the Correctional
Service Department had consulted the Smart Prison privacy issue. Could
you summarize what it has consulted and what point has been discussed,
and your recommendation about those issues, especially the video
analytic system issue?
3. Also, refer to your reply, could you clarify that it is legal to
set cameras in the prisoners' washroom? If yes, what consideration is
based on?
