Request under the Code on Access to Information for records concerning public complaints, referrals and follow-up actions relating to indoor air quality in shopping arcades
To: Access to Information Officer
Department: Environmental Protection Department (EPD)
Subject: Request under the Code on Access to Information for records concerning public complaints, referrals and follow-up actions relating to indoor air quality in shopping arcades
Under the Code on Access to Information, I am writing to request access to anonymised and aggregated records held or controlled by the Environmental Protection Department, the Food and Environmental Hygiene Department, the Electrical and Mechanical Services Department, the Buildings Department or any other relevant government department, concerning complaints, referrals and follow-up actions relating to indoor air quality (IAQ) in shopping arcades.
For the purposes of this request, “shopping arcades” includes private shopping malls, public housing estate shopping centres, government-managed markets and shopping centres, the commercial portions of community complexes, and other publicly accessible commercial premises.
1. Complaint statistics
For the calendar years 2021 to 2025, or the most recent five complete calendar years for which records are held by your Department or the relevant departments, please provide statistics on complaints received concerning indoor air quality in shopping arcades, broken down by the following pollutants or issue categories:
Fine suspended particulates (PM2.5);
Respirable suspended particulates (PM10);
Nitrogen dioxide (NO2);
Sulphur dioxide (SO2);
Ozone (O3);
Carbon monoxide (CO);
Carbon dioxide (CO2);
Total volatile organic compounds (TVOCs);
Formaldehyde;
Odour, inadequate ventilation, mould, dampness, temperature or humidity issues;
Suspected sick building syndrome.
For each category, please provide:
The number of complaints received each year;
The pollutants involved or suspected to be involved;
The source of the complaints, such as members of the public, tenants, property management offices, government departments or other organisations;
The number of shopping arcades or complaint cases involved.
If no such categorisation exists, please state that no such categorisation exists. A nil return, or confirmation that complaints are not categorised by these pollutants or issue categories, would itself be relevant evidence for the purposes of this request.
2. Departmental responsibilities and referral records
Please provide statistics showing which government department received, referred, investigated or handled the above complaints, including:
The number of complaints received or handled by the Environmental Protection Department, Food and Environmental Hygiene Department, Electrical and Mechanical Services Department, Buildings Department, Department of Health and any other relevant department;
The number of referrals between departments and the reasons for referral;
Any internal guidelines, workflow documents, inter-departmental memoranda, meeting records or policy documents used by the Government to determine the lead department responsible for complaints concerning shopping-arcade IAQ, ventilation systems, odour, mould, CO2, PM2.5, PM10, NO2, SO2, O3 or CO.
If no such categorisation or referral records exist, please state that no such categorisation or referral records exist.
3. Follow-up actions
For the above complaints, please provide statistics on follow-up outcomes, broken down by year and issue category, including:
The number of cases in which site inspections, environmental monitoring or air sampling were conducted;
The number of cases in which advice, recommendations, warnings, improvement notices or statutory directions were issued to shopping-arcade owners, management companies or tenants;
The number of cases in which enforcement, prosecution, summons or other compulsory action was taken;
The number of cases in which no further action was taken, the complaint was not substantiated, information was insufficient, or the complainant withdrew the complaint;
The number of cases in which complainants were informed of the investigation outcome or follow-up action.
If no such follow-up categorisation exists, please state that no such categorisation exists.
4. Air-quality monitoring and testing records
Where a government department has conducted air-quality monitoring, on-site measurement or commissioned testing in response to complaints concerning shopping arcades, please provide anonymised and aggregated statistics for 2021 to 2025, including:
The number of monitoring cases conducted;
The pollutants measured, including PM2.5, PM10, NO2, SO2, O3, CO, CO2, TVOCs and formaldehyde;
The number of cases in which measurement results exceeded relevant indicators, guideline values or action levels;
The number of cases in which testing results led to follow-up action.
If no such monitoring or testing records exist, please state that no such records exist.
5. Format of information and partial disclosure
I am seeking only non-personal, anonymised or aggregated information. I am not requesting any personal data capable of identifying individual complainants, tenants, employees or residents.
Where records are held in CSV, Excel, JSON, PDF or another electronic format, please provide the original or machine-readable version wherever possible. If your Department is unable to provide the complete information requested, please provide any existing summary reports, annual statistics, internal management records or other relevant partial information, and specify the scope and reasons for any information that cannot be provided.
If any part of the requested information is held by another government department, statutory body or private organisation, please identify the holder of that information and indicate the department or organisation to which the public should address a request.
Thank you very much for your time and assistance.
Yours faithfully,
Josh Wong
