Provision of Gender Affirming Care for Transgender Individuals in Correctional Institutions
Dear Correctional Services Department,
I am writing to submit an information access request regarding the provision of gender affirming care for transgender individuals in correctional institutions. May I know,
A) Would it be possible to provide an outline of the procedure that transgender individuals in custody must follow to access gender affirming care within the correctional institutions?
B) Which specific department or unit is responsible for overseeing the provision of gender affirming care to transgender individuals in the correctional institutions. Are Medical Officers from the Department of Health involved in this process, or are there psychiatrists or other medical specialists who play a role in the provision of such care?
C) What types of hormone therapy are made available to transgender individuals in custody? Specifically, could you clarify whether androgens, estrogens, both, or only one of these options are offered as part of the gender affirming care?
D) Would it be possible to provide a copy of the relevant procedures and guidelines pertaining to the matters discussed in questions A), B), and C).

Dear Sophie,
I refer to your application for access to information under the Code on
Access to Information (“the Code”) to this Department on 18.12.2023 and
our interim replies to you on 27.12.2023 and 5.1.2024.
The Correctional Services Department (“CSD”) is committed to providing a
secure, safe, humane, decent and healthy environment for persons in
custody (“PICs”). The CSD arranges transgender PICs to serve their
sentences in the Transgender Unit (“TU”) of Siu Lam Psychiatric Centre
(“SLPC”) in accordance with the established mechanism. Upon admission to
the TU of SLPC, transgender PICs would be requested to declare to the
institutional management information pertaining to their states of sex
reassignment surgery, medical treatment that they have received, etc.,
thereafter be examined by Medical Officers (“MOs”) seconded from the
Department of Health. Professionals including the aforesaid MOs, clinical
psychologists, psychiatrists and correctional officers with nursing
qualifications will provide transgender PICs with proper health care and
necessary treatments. Currently, both androgens and estrogens could be
prescribed to transgender PICs upon the recommendation of the MOs. If the
MOs consider it necessary, transgender PICs will also be referred to a
specialist clinic or public hospital for consultation and treatment.
Meanwhile, your request for a copy of the relevant procedures and
guidelines in regard to the requested information specified in items (A)
to (C) of your email could not be acceded to pursuant to para. 2.6(e) and
2.9(c) of the Code as the procedures and guidelines also contain other
essential information concerning the security and operational procedures
pertaining to the management of transgender PICs, the disclosure of which
would harm or prejudice the proper and efficient conduct of the operations
and security of the TU of SLPC.
Nonetheless, relevant information from the procedures and guidelines for
the management of transgender PICs as specified in the requested items (A)
to (C) of your email has been summarized above for your kind information
pursuant to para. 1.13 of the Code.
You may also wish to note that, pursuant to paragraph 1.25 of the Code,
any person who believes that a department has failed to comply with any
provision of the Code may ask the department to review the situation.
Furthermore, pursuant to paragraph 1.26 of the Code, any person who
believes that a department has failed to properly apply any provision of
the Code may also complain to The Ombudsman. The Ombudsman’s address is –
