I refer to your application under the Code on Access to Information
received on 15 April 2021.
The Government provides 9-year free and universal basic education to
children aged between 6 and 15. In general, and subject to the decision
of the Immigration Department (ImmD) in individual cases, there is no
objection to the entry and residence of a non-local child for the purpose
of attending a school registered under the Education Ordinance.
The Education Bureau (EDB), when approached by parents of these children
for placement assistance, will seek ImmD’s comments. Upon ImmD’s
confirmation that there are no comments on allowing these children to
attend schools in Hong Kong, the EDB will provide placement assistance as
appropriate having regard to their district of residence and learning
level.
Information available on the number of cases requiring placement
assistance from the EDB for children of non-refoulement claimants is as
follows:

Thank you for the information.
It is stated in Hong Kong's fourth report to the Committee on Economic, Social and Cultural Rights that "in 2017, EDB sought comments from ImmD on 193 cases. Among them were a total of 189 cases (98%) where eligible school-aged children of non-refoulement claimants were granted school placements in Hong Kong" (Annex 2H, paragraph 3, available at: https://www.cmab.gov.hk/doc/en/documents...).
I would appreciate if you could clarify the discrepancy between the figures provided in the Report and the figures you provided.

I refer to your further enquiry of 26 April 2021 regarding the number of
cases requiring placement assistance from the Education Bureau for
children of refugees and non-refoulement claimants in 2017.
The Education Bureau will update the total number of cases based on the
updated information received from time to time. The latest information
has been provided in our letter to you dated 23 April 2021.
