Thank you for your email dated 27 March 2022.  After consulting the
relevant subject division, please find our reply as follows:
 
As at 25.3.2022, there were –
 
(a)  1,432 civil servants who are medically unfit for COVID-19 vaccination
and remain unvaccinated.  
(b)  35 civil servants who are not medically unfit for COVID-19
vaccination and remain unvaccinated, of which 29 are pregnant officers.
(c)  6 civil servants did not comply with the vaccine pass arrangements
for government employees.  
 
We do not have breakdown on the number of directorate and non-directorate
officers.
 
Note: Civil servants on overseas posting/training or not on active service
are excluded.
 
2.     We have advised bureau/departments (B/Ds) to strictly enforce the
“vaccine pass” arrangements under which government employees who have not
received the required doses of COVID-19 vaccine and have not been exempted
will be deemed to not have fulfilled the access requirement as imposed by
the government as venue owner and should be denied access to the
government premises.  Upon implementation of the arrangement, staff who
are unable to comply with the requirements will not be allowed entry to
their places of work.  They will be no different from an officer who is
absent from his or her place of work without reasonable excuse, and such
periods of absence will be deemed as unauthorised.  If they enter
government premises without having fulfilled the requirements under the
“vaccine pass” arrangements for government employees, they will have
entered the premises without authorisation and may be liable to
disciplinary action and, depending on the circumstances, criminal
prosecution.  Individual B/Ds having the management and control of the
premises concerned should handle such cases by following standard protocol
as with any other unauthorised or forcible entry.
 
3.    Based on part 2.9(c) “Information the disclosure of which would harm
or prejudice the proper and efficient conduct of the operations of a
department” of the Code on Access to Information in respect of “Management
and operation of the public service”, we could not provide the
correspondences between CSB and B/Ds on the handling of staff who could
not comply with the vaccine pass arrangements.

Thanks for your reply dated 4.4.2022 advising the figures as at 25.3.2022.

On 25.4.2022, the Secretary of the Civil Service published the below figures, where 22 civil servants could not comply with the "Vaccine Bubble" arrangement -

"公務員事務局局長聶德權表示,截至本月初,有27名政府人員,包括22名公務員及5名其他政府僱員,因為未符合「疫苗通行證」措施而缺勤,其中5人已離開政府,對其他個案會採取相應行動。"

For the figures on civil servants who did not comply with the vaccine pass arrangements, the number of officers jumped from 6 to 22 during a short period from 25.3.2022 to 25.4.2022.

Please provide an explanation for the discrepancies of the data, and provide a detailed breakdown of civil servants who could not comply with the vaccine pass arrangements from 25.3.2022 and 25.4.2022.

Thank you for your email dated 29 April 2022.  After consulting the
relevant subject division, please find our reply as follows: 

 

The figure provided in our reply of 4 April 2022, i.e. 6 civil servants,
is the snapshot of civil servants who were in non-compliance with the
Vaccine Pass arrangement for government employees on 25 March 2022,
whereas the figure quoted in your email, i.e. 22 civil servants, is the
cumulative number of civil servants who were in non-compliance in the
period of implementation of the Vaccine Pass arrangement for government
employees starting from 16 February 2022 till early April.  The figures in
our previous reply and those in the Government’s announcement as quoted by
you are calculated on different basis. 

 

As at 22.4.2022, 2 civil servants did not comply with the Vaccine Pass
arrangement.
