Dear Correctional Services Department,

I am writing to make a data access request about the usage of CCTV at Tai Tam Gap Correctional Institution. May I know, from the start of its recommissioning as a detention centre until the last day of September 2021,

A) The number of CCTV cameras used at the facility

B) The locations of CCTV cameras at the facility

I) Are there CCTV cameras in (1) the toilets, (2) bathing or shower areas, and/or (3) rooms where detainees sleep?

C) Is the CCTV’s video recording function on at all times?

I) If no, what types of material are video-recorded?

II) How is recorded content stored and for how long?

D) Which members of staff (in terms of rank) have access to sensitive recorded materials, such as images/ video taken in bathroom/ bedroom that may infringe the privacy of detainees?

E) Could you provide the policies/guidelines/operational manuals which govern the use of CCTV in the institution?

If a CSV or Excel format is possible for the statistical data, I would greatly appreciate it.

Further to our interim reply of 22.10.2021, a substantive reply to your
request for information is as follows.
2.        CCTV system strengthens the correctional officers’ supervision
on PICs and their readiness in emergency response, thereby enhancing the
security and safety of the custodial environment at large.  The CCTV
system was set up and operated in accordance with the relevant laws and
guidelines, including the Personal Data (Privacy) Ordinance (Cap. 486) and
relevant guidelines issued by the Office of the Privacy Commissioner for
Personal Data.

3.        Concerning your request for details of the CCTV system including
the numbers and locations of CCTV camera and the operational details of
the system, we are unable to accede to your request on the grounds of
paragraph 2.6(e) of the Code on Access to Information (the Code).
 Paragraph 2.6(e) of the Code refers to information the disclosure of
which would harm or prejudice the prevention, investigation and detection
of crime and offences, the apprehension or prosecution of offenders, or
the security of any detention facility or prison.

4.        You may also wish to note that pursuant to paragraph 1.25 of the
Code, any person who believes that a department has failed to comply with
any provision of the Code may ask the department to review the situation.
 Furthermore, pursuant to paragraph 1.26 of the Code, any person who
believes that a department has failed to properly apply any provision of
the code may also complain to The Ombudsman.  The Ombudsman’s address is –
