The request was partially successful.

Dear Correctional Services Department,

I am writing to make an information request regarding immigration detainees held at Tai Tam Gap Correctional Institution (TGCI).

Under rule 201 of Part II of the Prison Rules (Cap. 234A), detainees may have an ‘option of employment’. Considering that the immigration detainees held at TGCI are governed under Part II of the Prison Rules but are also non-refoulement claimants who normally are not granted the right to work, I would like to understand:

1) Do immigration detainees at TGCI have the ‘option of employment’?

2) If so, what work is available to immigration detainees held at TGCI?

3) Is remuneration available and if so, what are the rates?

Thank you kindly for your help on this matter.

Yours faithfully,

H. Y. Fung
