We refer to your request for information made in your email dated 20
February 2020.  The information you requested is a copy of the Internal
Operating Procedures Manual (IOPM) and if that is not possible, the
disclosure can be of parts disclosable and not the whole document.

 

Please be informed that the IOPM is an internal document that contains
information relates to the management and operations of the EOC, provision
of a copy of the whole or parts of it would harm or prejudice or otherwise
adversely affect the proper and efficient conduct of the operation of the
EOC, including the discharge of its statutory functions. 

 

In view of the above, I regret to inform you that your request cannot be
acceded to in accordance with point 4.6 of the EOC’s Access to Information
Policy and Practice.  A link to it is appended below for your easy

I am writing to request an internal review of Equal Opportunities Commission's handling of my FOI request 'Internal Operating Procedures Manual'.

I requested for the whole or partial copy of the Internal Operating Procedures Manual under your access to information policy. My request was refused on the ground that disclosure of the manual would harm or prejudice or otherwise adversely affect the proper and efficient conduct of the operation of the EOC (para. 4.6).

The reason for refusal is unsound. The EOC has already published the content of some clauses in the Manual in their Process Review Report. This suggests the EOC has already deemed publication of some parts of the Manual will not prejudice the proper and efficient conduct of its operation. The information request should at least be met partially. I request that the EOC review its decision and provide the parts of the Manual that do not harm its proper operation.

Dear Mr LAU,

Thank you for your email of 5 March 2020 in which you requested for an internal review of our decision.

The prime objective of the Review of Governance, Management Structure and Complaint Handling Process (the Review) is to enhance the EOC's governance and complaint handling work. A few clauses from the Internal Operating Procedures Manual (IOPM) were used to illustrate the points covered in the report of the Review. The mentioning therein cannot be taken as publishing of any parts of the IOPM.

The EOC has considered your request and decided to maintain its decision of not releasing your requested information.
