I am writing to make an information request regarding migrant children who are taken into government care, NGO-run children homes, private-run children homes, or other relevant institutions. May I know,

1) In what circumstances a migrant child would be taken into a) government care b) NGO-run children homes, or c) private-run children homes?
2) What are the relevant guidelines and procedures in these circumstances?

Thank you for your email dated 18 March 2022 to the Immigration Department
(“ImmD”) for transferring your request for access to information on 14
February 2022 and clarification on 23 February 2022 to the Social Welfare
Department (“SWD”) regarding the migrant children who are taken into
government care, NGO-run children homes, private-run children homes, or
other relevant institutions:-

 

(1)   In what circumstances a migrant child would be taken into (a)
government care, (b) NGO-run children homes, or (c) private-run children
homes; and

(2)   What are the relevant guidelines and procedures in these
circumstances?

 

We noted from your email dated 23 February 2022 clarifying that you were
using the term “migrant” to refer to persons who do not have permanent
residency in Hong Kong.  Our reply is as follows:

 

The admission of a “migrant child” into NGO-run or private-run children
homes is subject to their respective criteria and procedures, and SWD does
not have this information.  A “migrant child” put under government care
(i.e. Tuen Mun Children and Juvenile Home) has to be ordered by the court,
or referred by Police or ImmD under respective ordinances.  SWD does not
have the guidelines and procedures of these parties.
