Dear Home Affairs Bureau (HAB),

Regarding the injury and death of the blind footballer Mr. Lam Wing-Shun, Terry (the Incident) after the First Hong Kong Open Football 5-A-Side Tournament (i.e. the Hong Kong Blind Football Open Tournament 2014), held on 16 & 17 December 2014, organised by the Hong Kong Blind Sports Federation Ltd (HKBSF) (relevant media report: http://harbourtimes.com/2015/07/17/arc-o...), I would like the HAB to provide the following information.

1. Will the HAB, or other relevant bureaux/departments, conduct investigation into the Incident?

2. Please provide the full video footage of the aforementioned football tournament on 16 & 17 December 2014. If the HAB cannot accede to the request, please also take into the public interest of the disclosure of the footage, in accordance with paragraphs 1.20 – 1.23 and 2.14 of the Code on Access to Information.

relating to the injury/death of a footballer at/after a tournament
organised by the Hong Kong Blind Sports Federation in December 2014.  

We regret to inform you that this Bureau is not in possession of any video
footage of the football match/tournament in question.  And since the case
concerned is now being handled by the Police, this Bureau does not plan to
conduct a separate investigation.

                        We refer to your further enquiry/request for
information dated 9.9.2015 with regard to a tournament organised by the
Hong Kong Blind Sports Federation in December 2014 and our interim reply
of 18.9.2015.

                        In accordance with paragraphs 1.6 and 1.14 of the
Code on Access to Information (the Code),  Government Bureau/Department
will provide members of the public with information relating to its
policies, services and other matters falling within its area of
responsibility but the Code does not oblige departments to acquire
information not in their possession.  As mentioned in our reply to you
dated 9.9.2015, this Bureau is not in possession of any video footage of
the football match/tournament in question.   You may consider approaching
the Police and/or the HK Blind Sports Federation Ltd direct for the
footage or any other information you wish to obtain.   In this connection,
you may also wish to note that paragraphs 1.20-1.23 and 2.14 of the Code
refer to information held by Government departments for a third party (or
provided to Government departments by a third party), and are therefore
not applicable in your request as this Bureau is not in possession of any
video footage of the football match/tournament in question.  Furthermore,
since the case is now being investigated by the Police, it is not
appropriate for us to take any action on this case pending completion of
the Police investigation.  

                As for your enquiry about issuing guidelines related to
the handling of injured participants in sporting events, this is
essentially a matter for the various individual sports associations and
other groups that organise sporting events in Hong Kong.   HAB has not
issued any guidelines of that nature.

                At your request (vide your email of 25.9.2015), Chinese
version of our earlier replies of 9.9.2015 and 18.9.2015 is appended below
please.  A Chinese version of this reply will be provided to you shortly.

根據《公開資料守則》(《守則》)第1.6及1.14段,政府各局╱部門會就其政策、服
務、決定及職責範圍以內的其他事宜,向市民提供相關資料,但《守則》並無強制部
門提供該部門沒擁有的資料。本局在二零一五年九月九日給你的回覆中,已表明並無
擁有該足球賽事╱公開賽的任何錄影片段。你可考慮直接與警方及╱或香港盲人體育總
會聯絡,請他們提供有關片段或你想索取的任何其他資料。關於這方面,希請留意《
守則》第1.20至1.23段及第2.14段中所指的資料是由政府部門為第三者持有的資料(
或由第三者向政府部門提供的資料),因此,由於本局並無擁有有關的足球賽事╱公
開賽的任何錄影片段,上述三段《守則》並不適用於你的要求。再者,鑒於警方現正
調查這宗案件,在警方完成有關調查前,我們不宜就此案件採取任何行動。
