Torture Claims Appeal Board/Non-refoulement Claims Petition Office: Re-hearings
Dear Security Bureau,
For all appeals/petitions that await determination and/or hearing before the Torture Claims Appeal Board ('TCAB')/Non-refoulement Claims Petition Office ('NRCPO'), can you please provide confirmation of the following:
(i) The number of appeals/petitions where there has/had already been a prior decision given/issued by the TCAB/NRCPO; and
(ii) The number of cases at (i) which followed a remittal/settlement in respect of Judicial Review proceedings;
Please also specify as amongst (i) and (ii), the following:
(a) those which relate to cases awaiting further hearing/s; and
(b) those which following any further hearing/s, await written decision/determination.

Dear Mr Shaffer,
I refer to your email of 16 January 2019 requesting us to provide
information on the number of outstanding appeals/petitions ("appeals")
where there has/had already been a prior decision given/issued by the
Torture Claims Appeal Board/Non-refoulement Claims Petition Board ("the
Board").
As at 31 December 2018, the number of outstanding appeals which followed a
remittal/settlement in respect of judicial review proceedings against a
prior decision given/issued by the Board is as follows -
Pending decision Pending hearing/ further hearing Total
10 29 39
Apart from the above, the Board does not keep statistics on the number of
appeals where there has/had already been a prior decision given/issued by
the Board and thus, cannot be provided as requested.
