We refer to your requests for information made in your two emails dated 22
January 2020.  The information you requested is as follows:

 

(1)    the set of revised statistics provided to Prof Anselmo Reyes for
the production of the Independent Report on the EOC’s complaint handling
process (page 63, footnote 1 of “Report on Review of the Equal
Opportunities Commission Governance, Management Structure and Complaint
Handling Process”);

(2)    If not for (1), same information as on page 112 of the “Report on

For (1), please be informed that all the statistics provided to Prof Reyes
were compiled through an ad hoc exercise and the statistics so provided
have been reflected in Prof Reyes’ Report. The EOC does not keep a record
of the statistics per your request.

 

For (2), as stated above, the statistics provided to Prof Reyes were
compiled through an ad hoc exercise. No “data before 2008 and after 2017”
was compiled and provided to Prof Reyes in the ad hoc exercise. The
information per your request is hence not available.

 

For (3), Prof Reyes has only provided a hardcopy of the Independent Report
to the EOC. The EOC does not have a version of the report in a
text-selectable format.

Dear EOC,

Given that the statistics were compiled for Prof Reyes for 2008-2017 in an ad-hoc exercise, I presume that the EOC has the raw data to compile such statistics. I request under the Code on Access to Information (which I did as (2) in my previous email) to have the EOC compile the data before 2008 and after 2017 specially for this information request.

Under the EOC’s Access to Information Policy and Practices, the information which may be requested shall comprise documents and records which are already in existence and in possession of the EOC. As explained in my email of 11 Feb 2020, no statistics “before 2008 and after 2017” were compiled and provided to Prof Reyes in the then ad hoc exercise, your requested information does not ever exist. I know the EOC did not provide Prof Reyes with the information before 2008 and after 2017. But that does not mean the information does not exist per se. They were compiled for Prof Reyes, as I understand from your previous email, in an ad-hoc exercise, but whether such information was compiled for a certain purpose and whether such information exists are separate questions.

I am requesting for the records themselves which were presented in the report, that is:
- cases concluded by CIC and SII respectively by year
- pledges met by CIC and SII respectively by year
- cases discontinued after assessment and investigation respectively by year
- cases discontinued for other reasons by year
- cases with successful early conciliation
- cases with successful post-investigation conciliation
- cases with unsuccessful conciliation

The EOC should possess at least some of the above records, as your annual reports include statistics that rely on these metrics, such as conciliation rates, complaints concluded in your performance pledge, etc.
